DECLARII~G INTENT OF THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC UTILITY DISTRICT FOR SALE DATES OF GENERAL OBLIGATION BONDS AND TI~E$ OF EXPENDITURES OF PROCEEDS OF SAID GENERAL OBLIGATIONS BOI~DS SOUTH TAHOE PUBLIC UTILITY DISTRICT SEWER PROJECT WHEREAS, in 1959, SOUTH TAHOE PUBLIC UTILITY DISTRICT incurred a $2,500,000 general obligation bonded indebtedness for con- struction of a new S~getreatment and force main plant sewage system to meet the then anticipated requirements of said district through the year 1965; and WHEREAS, all of said bonds were sold and the proceeds thereof, together with a Federal grant in the amount of ~250,000 were used to construct a new sewage treatment plant and force main sewage system for said SOUTH TAHOE PUBLIC UTILITY DISTRICT; and WHEREAS, a sewage survey report of Brown and Caldwell, Civil and Chemical Engineers, on which said bond issue was based, predicted expenditure of said $2,500,000 and Federal grant funds would provide an adequate treatment plant and force main sewage system for SOUTH TAHOE PUBLIC UTILITY DISTRICT through the year 1965; and WHEREAS, the population growth and sewage treatment and disposal requirements for SOUTH TAHOE PUBLIC UTILITY DISTRICT predicted in said report for the year 1965 hawenow been attained; and WHEREAS, said general obligation bond issue did not provide funds for acquisition of lands by SOUTH TAHOE PUBLIC UTILITY DIS- TRICT for disposal in a healthful manner of highly treated effluent eminating from said district; and WHEREAS, th~ Lahontan Water Pollution Control Board of the State of California has requested and now demands of SOUTH TAHOE PUBLIC UTILITY DISTRICT reports on and progress for the immediate solution and long range planning for disposal of 2 4 5 6 7 8 9 10 11 12 14 15 16 17 18 19 20 9.1 24 25 26 27 28 $0 ~MN C. NATIONAL sewage effluent by said district; and WHEREAS, publicity in 1961 of one overflow of highly treated effluent from the holding pond of South Tahoe Public Utility District threatened damage to the economy of said district and the entire South Tahoe Basin even though said one overflow did not contaminate or pollute waters of Lake Tahoe or those tributary thereto; and WHEREAS, there is need in the year 1962 for acquisition of lands for and construction of a spray disposal system thereon for disposal of effluent, expansion of the existing treatment plant in the year 1963, and construction of an additional force main and provision for further tertiary treatment in the year 196~ to provide for the treatment of sewage and disposal of effluent by SOUTH TAHOE PUBLIC UTILITY DISTRICT for the now anticipated population to the year 1970; and WHEREAS, this need for sewage disposal by SOUTH TAHOE PUBLIC UTILITY DISTRICT is necessary for the continuation of orderly growth and development of said district and of the Lake Tahoe Basin; and WHEREAS, Lake Tahoe is a recreation area which must be preserved in its natural beauty; and WHEREAS, the directors of SOUTH TAHOE PUBLIC UTILITY DISTRIC~. recognized the sewage requirements of said district for sewage disposal to the year 197©, and in October, 1961, authorized their engineer, Clair A. Hill & Associates to research and report to the district their recommendations to meet this sewage need; and WHEREAS, in accordance with long range planning principles, said engineer was directed to prepare a plan to care for the sewa needs of SOUTH TAHOE PUBLIC UTILITY DISTRICT, not upon an emergency basis, but upon a plan for at least eight years; and WHEREAS, said engineer has so reported to the SOUTH TAHOE 1 $ 4 § 6 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 24 25 26 27 28 29 50 $1 ~_,N C. WEIDMAN ATTORNEY AT LAW 325 MAIN STREET PLAClER¥ I LLE, CALIF, NATIONAL 2-5260 PUBLIC UTILITY DISTRICT and recommends the following staged program and has estimated the expenditures therefor: STAGE YEAR PROJECT One - 1962 Two - 1963 Three-196& or later Land Acquisition Disposal facilities Treatment Plant Addition Bijou Force Main Additional Tertiary Treat- ment ESTIMATED COST $520,000.00 400,000.00 750,000.00 290,000.00 550,000.00 Total Estimated Costs $2,510,O00.00 and WHEREAS, the Lake Tahoe Area Council, through a Fleischman Foundation grant is currently engaged in an engineering study on disposal of sewage for the entire Lake Tahoe Basin, but that a report thereon by said Lake Tahoe Area Council is not anticipated until the year 1964; and WHEREAS, the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT not on an emergency planning basis, but to carry out the longer range plan authorized and recommended to meet the sewage disposal requirements of said District to the year 1970, have adopted said engineers recommendations and submitted to the voters of said district for their approval at the general district election on May l, 1962, the proposition of incurring a bond indebtedness in the sum of $2,510,000.00 to effectuate said plan as aforesaid; and WHEREAS, the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT have further determined that it would be in the best interests of said district and the tax payers of said district, to have available bond funds to effectuate said plan for sewage disposal to the year 1970, approved at said district election; and WHEREAS, the tax payers of said district are ~sirous of know- ing when expenditures for said sewage system will be ,made, the 2 5 4 5 6 ? 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 25 24 25 26 27 28 29 50 $1 ~N C. NATIONAL 2-5260 dates of bond sales therefor, arid when taxes in retirement thereof will become a charge against their properties; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT, as a declaration of intent, that upon passage of said general obligation bonded indebtedness on May l, 1962, by the voters of said district that said general obligation bonds will be sold, and the expenditure and proceeds thereunder made approximately in accordance with the following schedule: STAGE YEAR PROJECT One - 1962 Two - 1963 Three - 1964 or later Land Acquisition Disposal Facilities Treatment Plant Addition Bijou Force Main Additional Tertiary Treatment ESTI~V~TED COST $520,000.00 400,000.00 750,000.00 290,000.O0 550,000.00 BE IT FURTHER RESOLVED that any bonds sold for the purpose of the construction of a Bijou Force Main shall be expressly contingent upon the requirement of greater California use of such a force main. BE IT FURTHER RESOLVED that any said bonds sold for purpose of additional tertiary treatment will not be sold until 1964, or until the results of the Lake Tahoe Area Council engineering study on disposal of sewage for the Lake Tahoe Basin are known and considered by the Board of Directors of South Tahoe Public Utility District, whichever shall first ~ccur. PASSED and adopted at a regular meeting ~f the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT this 5th day of April, 1962, by the following vote: AYES: Directors Souza, Wakeman, Clarke, Imbach, and Burlingham.
