Resolution No. 449 1 $ 4 § ? 8 10 11 12 15 17 18 19 20 21 24 28 28 27 28 $0 $1 RESOLUTION N0o 449 A RESOLUTION OF THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC UTILITY DISTRICT ORDER- ING EXCLUSION OF TERRITORY PURSUANT TO SECTIONS 17501 THROUGH 17510 OF THE PUBLIC UTILITIES CODE OF THE STATE OF CALIFORNIA WHEREAS, a petition of KNOX VAN DYKE JOHNSON, TA~ILLIAM VAN DYKE JOHNSON and M~RJORIE JOHNSON SPRINGMEYER to have excluded from the SOUTH TAHOE PUBLIC UTILITY DISTRICT certain parcels of real property situate within said District and the County of E1 Dorado and more particularly described in said petition wa~receive by said SOUTH TAHOE PUBLIC UTILITY DISTRICT on July 29, 1963, and filed in the office of said District on July 29, 1963; and WHEREAS, the Clerk and Ex-officio Secretary of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT at its regular meeting on August 15, 1963, set a time and place for the hearing of said petition as the 5th day of September, 1963, at $:00 o'clock P.Mo at the regular meeting place of the Board of Directors of said District at the Tahoe Valley Fire Station, Tahoe Valley, E1 Dorado County, California; and WHEREAS, the Clerk and Ex-officio Secretary of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT caused to be published in a newspaper of general circulation within said Utility District and the County of E1 Dorado, State of California, to wit, "Tahoe Daily Tribune~, a notice of filing said Petition for Exclu- sion of Territory and including therein a notice of the time and place for hearing of said petition; and WHEREAS, an affidavit of publication of said notice of filing Petition for 'Exclusion of Territory was filed with the SOUTH TAHOE PUBLIC UTILITY DISTRICT on September 5, 19~3 by said Clerk and Ex-officio Secretary of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT, showing publication of said notice in said newspaper on August 20, 1963~ and August 27~ 1963~ and d 1 3 4 5 6 7 8 9 10 ll 12 13 14 15 16 17 18 19 2O 22 23 24 25 26 27 28 29 30 31 32 ~HEREAS, a hearing has been held in accordance with said notice upon said petition at $:00 o'clock P.M. on September 5, 1963, at the regular meeting place of said Board of Directors in said District at the Tahoe Valley Fire Station, Tahoe Valley, E1 Dorado County, California; NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the SOUTH TAHOE PUBLIC UTILITY DISTRICT as follows: 1o That the Board of Directors of the SOUTH TAHOE PUBLIC UTILITY DISTRICT determines that it is for the best interests of the said District that all lands mentioned in said Petition of KNOX VAN DYKE JOHNSON, WILLIAM VAN DYKE JOHNSON and MARJORIE JOHNSON SP~INGMEYER be excluded from the SOUTH TAHOE PUBLIC UTILIT~ DISTRICT, and that it appears that all such land is owned by said petitioners, named in this paragraph, and that said land will not be benefited by continued inclusion in the SOUTH TAHOE PUBLIC UTILITY DISTRICT. 2. That the real property, land and territory so excluded is owned by the petitioners and is described in EXHIBIT A attached hereto, and made a part hereof by reference° 3o The real property, land and territory so excluded is owned by said petitioners and delineated on maps marked '~Exhibit B' and '~Exhibit C", respectively, which said Exhibits are attached hereto, made a part hereof, and incorporated herein by reference° 4o The Clerk and Ex-officio Secretary of the Board of Directors of the SOUTH TAHOE PUBLIC UTILITY DISTRICT be, and he is hereby instructed, to enter this resolution ordering exclusion of said real property in the minutes of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT as an order excluding said rea~ property from the SOUTH TAH©E PUBLIC UTILITY DISTRICT, and said Clerk and Ex-officio Secretary of the Board of Directors of said District be, and he is further instructed to record a copy of 2. 1 4 5 6 ? 8 9 10 11 12 15 14 15 16 17 18 19 2O 21 22 24 25 26 27 28 29 this resolution ordering said exclusion of said real property, certified by said Clerk and Ex-officio Secretary of the Board of Directors of said District~ in the office of the County Recorder of the County of E1 Dorado~ State of California~ the county in which said SOUTH TAHOE PUBLIC UTILITY DISTRICT is situate.
