Resolution No. 505WHJ&M: JHH: gb 4/28/64 12 C RESOLUTION NO. $ 0 5 A RESOLUTION AND ORDER APPROVING PROPOSED ANNEXATION AND CHANGING BOUNDARIES OF DISTRICT ANNEXATION NO. 1964-2 RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, that WHEREAS, a petition signed by a majority of the owners of ter- ritory proposed to be annexed who are also the owners of a majority of the assessed valuation of said territory in certain unincorporated territory contiguous to the South Tahoe Public Utility District, and being in the same County as said District, asking that such territory be annexed to said District and consenting to such annexation without an election and without any special terms and conditions, was addressed to the Board of Directors and filed with the Secretary of the District on the 19th day of March, 196~ in accordance with the provisions of the Public Utility District Act of the State of California; WHEREAS, the Clerk and ex-officio Secretary of the District has compared the signatures of said petition with the affidavits of regis- tration on file with the County Clerk of E1 Dorado Countyj and has found and certified to this Board that said petition has been signed by the required number of owners in said territory, and has attached his signature to the said petition and presented said petition to this Board; WHEREAS, on the 19th day of March, 1964, this Board adopted its Ordinance No. 107 entitled, "An Ordinance Describing Territory Proposed to be Annexed, Determining that no Terms and Conditions are Necessary, and Declaring Intention to Approve Such Annexation," wherein it did des- cribe the territory proposed to be annexed, declare its intention of approving such annexation without any special terms and conditions, and give notice fixing the time and place of hearing thereon and notifying all persons interested in, or that may be affected by the proposed annexation of said territory within the District, to appear at such meeting and show cause~ in writing~ if any they have~ why said ter- ritory or any of it should not be annexed as proposed in said petition~ WHEREAS, said ordinance and notice were filed with the Secretary of the District and published and posted for the time and in the manner provided by law; and WHEREAS, no persons interested filed with the Board written pro- tests to the annexation or to the approval of no terms and conditions and no owners of taxable property in the territory proposed to be annexed filed written protests to the proposed annexation or to the approval of no terms and conditions~ and after due consideration of said protests this Board has found that all of said property proposed to be annexed will be substantially benefited by annexation and has not modified the boundaries of the property proposed to be annexed. NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED as follows: 1. That the territory described in said petition will be sub- stantially benefited by annexation to said District and that said Dis- trict will be substantially benefited by annexing said territory to said District. 2. That the boundaries of said District are hereby changed by including therein the territory described in said petition. 3. That the territory so annexed and the exterior boundaries thereof are more particularly defined and established as set forth in Exhibit "A" hereto attached and by reference made a part hereof. 4. That a certified copy of this resolution and order shall be filed for record in the office of the County Recorder of the County of E1 Dorado. ATTEST: C'le~k a~ e'x-OffXclo S'ec'r'&ta/~y" - 2 - The foregoing is a full~ true and correct copy of a resolution which was duly and regularly adopted at a meeting of the Board of Directors of the South Tahoe Public Utility District~ E1 Dorado County~ California~ duly held on the 7th day of Mays 1964j by the following vote of the members thereof: AYES, and in favor thereof~ Directors:cLARKE' WAKEMAN, KORTES~ FESLER AND STEWART NOES~ Directors: NONE Directors: ABSENT: South Tahoe Public Utility~/District - 3- EXHIBIT "A" ANNEXATION NO. 1964-2 SOUTH TAHOE PUBLIC UTILITY DISTRICT All that certain real property situate in the County of E1 Dorado, State of California, more particularly described as follows: PARCEL NO. 1: A portion of Section 33, Township 13 North, Range 18 East, M.D.B. & M., as follows: BEGINNING at the Northeast corner of the parcel herein de- scribed, a 3/4 inch capped iron pipe from which the East quarter corner of said Section 33 bears South 85° 34' 10" East, 2663.74 feet; thence from point of beginning South 0° 10' West, 181.00 feet, a similar pipe3 thence South 15° 00' 30" West, 112.50 feet, a similar pipe; thence South 22° 00' East, 14.00 feet, a similar pipe on the Northerly boundary of U. S. Highway No. 50, as de- scribed in Deed recorded September 10, 1930 in Book 119, at Page 482, Official Records of E1 Dorado County, the Southeast corner~ the~ce along said Northerly boundary South 69° 23' West, 117.29 feet, a similar pipe; thence leaving said boundary North 200.00 feet, a similar pipe; thence West 80.00 feet, a similar pipe, on the West boundary of the land described in Deed to Elizabeth Morrlson Gay, et al, recorded September 17, 1956, in Book 389, Official Records of E1 Dorado County, at Page 556; thence North 126.40 feet, a similar pipe, the Northwest corner; thence North 85° 19' East, 214.90 feet to the point of beginning, containing 1.158 acres, more or less. PARCEL NO. 2: A portion of Section 33, Township 13~ Range 18, M.D.B. & M., more particularly described as follows: COMMENCING at the Southeast corner of the parcel herein described, a 3/4 inch capped iron pipe on the Northerly boundary of U. S. Highway 50, as described in Deed to the State of Cali- fornia, recorded September 10, 1930, in Book 119, at Page 482, Official Records of E1 Dorado County, from which pipe, the East 1/4 corner of said Section 33, bears North 69° 23' East (cited North 69° 12' East) 117.29 feet, North 22° 00' West, 14.00 feet~ North 15° 00' 30" East, 112.50 feet, North O0° 10' East, 181.00 feet and South 85° 34' 10" East, 2663.74 feet, said point being the Southwest corner of the parcel of land described in Deed to The Travelodge Corporation, a California corporation, recorded June 8, 1961 in Book 552, at Page 582, Official Records of E1 Dorado County; thence the North 200.00 feet, to a similar pipe; thence West 80°00 feet to a similar pipe on the West boundary of the parcels of land described in Deed to Elizabeth Morrison Gay, a married woman, and Daryl Eugene Morrison, recorded September 17, 1956, in Book 389, at Page 556, Official Records of E1 Dorado County; thence South, along the West line of said Gay and Morrison parcel, 230.10 feet to a similar pipe on the North line of said Highway 50 aforementioned; thence North 69° 23' East (cite North 69° 12' East), along the North line of said Highway 50, 85.47 feet to the point of commencement.
