WEIDMAN RESOLUTION NO. 616 A ~ESOLUTION OF THE BOARD OF DIRECTORS OF TI~E SOUTH TAHOE PUBLIC UTILITY DISTRICT M~KING ~ETERMINATIONS AND APPROVING THE PROPOSED ANNEX~TION OF TE~RITORY, DESIGNATED AS "SOUTH TAH0'E ANNEXATION NO. 1965-1~", TO THE SOUTH TAHOE PUBLIC UTILITY DISTRICT RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, ~l Dorado County, Cali£ornia, as follows: ~EREAS, on October 21, 1965, this Board adopted its Resolution No. 596, "A Resolution of Application by South Tahoe Public Utility District Requesting that Local Agency Formation Commission Take Proceedings for Annexation of Territory to the District, South Tahoe Annexation Noo 1965-1~", which resolution, together with a form of written consent of all of the owners of land o£ all the territory proposed to be annexed was filed with the ~Executive Officer of the Local Agency Formation Co~mission o.f the County o£ E1 Dorado; and WHEREAS, on November 16, 1965, the Local Agency Forma- tion Commission of E1 Dorado County adopted its Resolution No. 34-65, "A Resolution of the Local Agency Formation Commission of the Co~n-ty of E1 Dorado Making Determinations and Approving 'the Proposed ~nnexation of Territory, Designated as South Tahoe Annexation No. 1965-1~, to the South Tahoe Public Utility District"; and WHEREAS, said Resolution Noo 3~-6~ of the Local Agency Formation Commission of E1 Dorado County approved the proposed annexation and authorized this Board of Directors to anne~ said territory without notice and hearing and without an election; and WHEREAS, a form of written co~sent signed 'by all o£ the owners of land of ~he territory proposed to be annexed has been filed ~th the District; 1 2 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 19 2O 21 25 24 25 26 27 28 29 $0 51 · Ir'IHN C. WEIDMAN THAT: NOW, THEREFO~E~ IT IS FOUND~ ~ETEPd~INED AND 1o The territory proposed to be annexed is uninhabited~ as such term is defined in Government Code~ Section ~60~ and the description of the exterior boundaries of the territory is set forth in Exhibit A attached hereto and made a part hereof, and that no written protests were filed. 2. Annexation is approved subject to the terms and conditions as contained in the aforementioned Resolution No. 596 adopted October 21~ 1965, by the Board of Directors of the South Tahoe Public Utility District, which said terms are attached hereto~ marked Exhibit B~ and made a part hereof. In the event the Distriet shall require any payment of a fixed or determinable amount of money, either as a lump sum or in installments, for the acquisition, transfer, use o~r right of use or any part of the existing property~ real or personal, of the District, such payment will be made as follows: If payment in a lump sum is required, payment of such sum shall be made in cash to the District prior to the effectiwe date of such annexation; or If payment in installments is required, an agreemenl providing for such payment shall be duly executed with the District prior to the effective date of such annexation° 2o Upon and after the effective date of said annexation the territory~ all inhabitants within such territory, and all persons ~ltitled to vote by reason of residing or owning land within the territory shall be subject to the jurisdiction of the District, shall have the same rights and duties as if the territory had been a part of the District upon its original formation, shall be liable for the payment of principal, interest~ and any other amourYos which shall become due on account of any outstanding or 'then authorized but thereafter issued bonds~ including revenue bonds, or other contracts or obligations of the District and shal~ be subject to the levying or fixing and collection of any and all taxes~ assessments~ se?vice charges, rentals~ or rates as may be necessary to provide for such payment° ~EXHIBIT B 2 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 24 25 26 27 28 29 $0 51 ~.Ir-IHN E].
