A RESOLUTION OF THE BOARD OF DIRECTORS OF
SOUTH TAHOE prUBLIC UTILITY DISTRICT ~KING
DETERMINATIONS AND APPROVING THE PROPOSED
ANNEX~TION OF TERRITORY DESCRIBED AS
"SOU~HTAHOE ANNEXATION NO. 1965-3", TO THE
SOUTH TAHOE PUBLIC UTILITY DISTRICT
RESOLVED, by the Board of Directors of South Tahoe Public
Utility District, County of E1 Dorado, State of California, as
follows:
WHEREAS, a petition for proposal to annex territory to thc
South Tahoe Public Utility District in the County of E1 Dorado,
State of California, was filed with the Local Agency Formation
~ommmssmon of the County of E1 Dorado; and
WHE~EAS~ on October 7, 1965~ the Local Agency Formation
Commission of E1 D~ado County adopted its Resolution No. 22-65,
"A Resolution of the Local Agency FOrmation Commission of the County
~f E1 Dorado Making Determinations and Approving the Proposed
[nnexation of Territory~ Designated as'South Tahoe Annexation Noo
1965-3', to the South Tahoe Public Utility District?,which said
resolution approved the annexation of territory described in said
petition for proposal to annex territory~ and
WHEREAS, on October 21, 1965, the South Tahoe Pnblic
Utility District adopted its Resolution No. 595, '~A Resolution of
the Board of Directors of South Tahoe Public Utility District
Initiating Proceedings for Annexation of Territory to the South
Eahoe Public Utility District and Fixing a Time, Date and Place of
~earing on the Proposed Annexation Designated as'South Tahoe
[nnex~tion Noo 1965-3' to the South Tahoe Public Utility District,,,
which said resolution described territory proposed to be annexed
which was described in said petition for proposal to annex and said
Resolution No. 22-65 of the Local Agency Formation Commission of E1

WHEREAS, notice of time, date and place of hearing on
said proposed annexation was published, posted and mailed by the
Clerk o£ South Tahoe Public Utility District in the manner provided
by law; and
WHEREAS, a hearing was held pursuant to said Resolution
No. 595 at the time, date and place fixed for said hearing; and
~&HEREAS, said Local Agency Formation Commission's
Resolution Noo 22-65 was summarized at the hearing of the Board of
Directors of South Tahoe Public Utility District prior to
consideration of pr~teat~; ~nd
WHEREAS~ at said hearing no persons interested presented
any oral or written protests, objections, or evidence of protests
to the proposed annexation or to the approval of the terms and
conditions hereinafter set forth of said proposed ~nexation; and
~HEREAS, the Board of Directors considered all matters
at said hearing required to be considered by Section 5631~ol of the
Government Code of the State of California; and
WHEREAS, there were no written protests filed and not
withdrawn in accordance with the provisions of Sections 56316 and
56.317 of said Government Code.
NOW, THEREFORE, IT IS 0R~ERED AS FOLLOWS:
1o That the annexation of the territory described in the
~etition for proposal to annex territory to the South Tahoe Public
Itility District and said Local Agency Formation Commission of
51 Dorado~County Resolution No. 22-65 and Resolution Noo 595 of the
~outh Tahoe Public Utility District is approved and ordered annexed
o the South Tahoe Public Utility District, County of E1 Dorado~
tate of California°
2. That the boundaries of said District are hereby changed
oy including the territory described in said petition and
?esolutions.

thereof are more particularly defined and established as set forth
in E~HIBIT A attached hereto and by reference made a part hereo£o
4. That the terms and conditions of said annexation
are those as set forth in ~HIBIT B, attached hereto and by
reference made a part hereof.
5. That the Clerk of South Tahoe Public Utility Distric
shall file a statement of change of boundaries with the County
Assessor of the County of E1 Dorado and the Board of Equalization
of the State of California in tm manner provided by Section
54900, et seq.~ of the Government Code of the State of California.
6. That the Clerk of said District shall file a
certificate of completion with the Secretary of State of the State
of California~ and after receiving a certificate of filing thereof
from said Secretary of State, said Clerk shall record the original
or a counter-part original of said certificate of filing, together
with an original or counter-part original of the said certificate
of completion with the County Recorder of the County of E1 Dorado,
State of California, as provided in Section 56452 of the Governmen~
Code of the State of California.
PASSED AND ADOPTED at a duly held adjourned regular
meeting of the Board of Directors of South Tahoe Fublic Utility
District on November $, 1965, by the following vote:

EXHIBIT B
1. In the event the District shall require any payment
of a fixed or determinable amount of money~ either as a lump sum
or in installments~ for the acquisition~ transfer~ use or right
of use or any part of the existing property~ real or personal~ of
the District~ such payment will be made as follows:
(a} If payment in a lump sum is required~ payment of
such sum shall be made in cash to the District
prior to the effective date of such annexation; or
(bi If payment in installments is required~ an
agreement providing for such payment shall be
duly executed with the District prior to the
effective date of such annexation.
(c]
In lieu of any payment set forth in (al or (b}
above~ payment may be made through
1/ The formation of a new improvement district
or districts or the annexation or detachment
of territory to or from any existing improvemen,
district or districts;
2/ The incurring of new indebtedness or liability
by or on behalf of all or any part of any
district or of any existing or proposed new
improvement district therein;
The issuance and sale of any bonds~ including
authorized but unissued bonds°

2o Upon and after the effective date of said annexa-
tion~ the~,T~rPitory~ all inhabitants within such Territory~ and
all persons entitled to vote by reason of residing or owning land
within the Territory shall be subject to the jurisdiction of the
District~ shall have the same rights and duties as if the Territ
had been a part of the District upon its original formation~ shall
be liable for the payment of principal~ interest~ and any other
amounts which shall become due on account of any outstanding or
then authorized but thereafter issued bonds~ including revenue b
or other contracts or obligations of the District~ and shall be
subject to the levying oF fixing and collection of any and all tax
assessments~ service charges~ rentals or rates as may be nece
to provide for such payment.
