Resolution No. 575RESOLUTION NO. 575 A RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD OF DIRECTORS OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT TO EXECUTE AN AGREEMENT FOR TRANSFER OF REAL PROPERTY FROM LAKE VALLEY FIRE PROTECTION DISTRICT TO THE SOUTH TAHOE PUBLIC UTILITY DISTRICT. BE IT RESOLVED by the Board of Directors of the SOUTH TAHOE PUBLIC UTILITY DISTRICT, County of E1 Dorado, State of California, as follows: 1. That the President of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT be, and he is hereby authorized to execute an agreement for transfer of real property from LAKE VALLEY FIRE PROTECTION DISTRICT to the SOUTH TAHOE PUBLIC UTILITY DISTRICT, which agreement is attached to this Resolution and incorporated herein by reference. PASSED AND ADOPTED at a regular meeting of the Board of Directors of South Tahoe Public Utility District on August 5, 1965, by the following vote: AYES: Directors Clarke, Wakeman, Fesler, Stewart and Kortes NOES: None ABSENT: None D~ald L. Callahan, Clerk of the SOUTH TAHOE PUBLIC UTILITY DISTRICT and ex Officio Secretary of the Board of Directors thereof (SEAL) AUG 80!,G65 AGREEMENT FOR TRANSFER OF RF, AL PROPERTY FROM LAKE VALLEY FIRE PROTECTION DISTRICT TO THE SOUTH TAHOE PUBLIC UTILITY DISTRICT This Agreement made between the Lake Valley Fire Protection District, County of El Dorado, State of CalifornA~, a public agency, hereinafter designated as Fire District and South Tahoe Public Utility District, County of El Dorado, State of California, a public agency, hereinafter designated as Utility District witnesseth: WHEREAS Fire District is the owner of that certain real property situate in the Gounty of El Dorado, State of California, described as: Lot 38, Bijou Park Subdivision, as said Lot is marked, numbered and designated on the Official Map of said Bijou Park Subdivision, filed in the Office of the County Recorder of the County of El Dorado, State of California, on September 2, 1927, in Book A of Maps, Map No. 10; and WHE~, under agreement dated September I, 1953, Utility District has been granted the use of the rear (or northerly) fifty (50) feet of said property for the construction, maintenance and operation of a sanitary sewerage pumping station; and WHE~, Utility District has constructed and is maintaining and operating a sewerage pumping station thereon; and VCHEREAS the contracting parties have agreed that it is in the best interests of the public of each of the two districts that the property so used by Utility District be transferred and conveyed to Ut/llty District from Fire District upon the terms and conditions hereinafter set forth; now therefore: 1T IS AGREED: 1. In consideration of the promises and agreements of Utility District herein contained, Fire District shall convey to Utility District, by good and sufficient grant deed, the most northerly fifty ($0) feet of said Lot 38. 2. Utility District shall provide the necessary legal description to effectuate the conveyance. 3. In consideration of said conveyance, Utility District agrees it shall not at any time impose any assessments, fees, tolls, connection charges, inspection fees, or other fees or charges for services rendered to any property of Fire District located within the boundaries of Utility District. 4. The provisions hereof shall be binding upon and shall inure to the benefit of the parties hereto and any successors thereof which shall also be public agencies.
