Resolution No. 738WJML:KIJ:gt 11/7/66 10c RESOLUTION NO. ,~ 7 5 8 RESOLUTION AND ORDER ADOPTING ENGINEER'S REPORT, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE AND ORDERING THE WORK AND ACQUISITIONS AND ORDERING THE FORMATION OF A ZONE WITHIN THE SOUTH TAHOE PUBLIC UTILITY DISTRICT TO FINANCE,SAME MEYERS AREA SEWER PROJECT RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, E1 Dorado County, California, that WHEREAS, on the 6th day of October, 1966, said Board adopted its Resolution of Intention NO. 723 to acquire and construct improvements and to form a zone within the South Tahoe Public Utility District to finance same, and referred the proposed acquisitions and improvements to Clair A. Hill & Associates, Consulting Engineers of said District, being the officer having charge and control of the construction of improvements in and for said District of the kind described in said ResOlution of Intention and being a competent person appointed by said District for that purpose; WHEREAS, said Board thereby directed said Engineers to make and file with the Secretary of said District a report in writing in accordance with and pursuant to Division 7 of the Public Utilities Code of the State of California; WHEREAS, said report was duly made and filed with the Secretary of said District, whereupon said Secretary presented it to the Board for consideration; WHEREAS, said Board thereupon duly considered said report and each and every part thereof and found that it contained all the matters and things called for by the provisions of said Code, in- cluding (1) plans and specifications of the proposed improvements, (2) estimate of costs, and (3) maps and descriptions of lands, rights of way and easements necessary to be acquired, all of which was done in the form and manner required by said Code; WHEREAS, said Board found that said report and each and every part thereof was sufficient in every particular and determined that it ~should stand as the report for all subsequent proceedings under said Code, whereupon said Board, pursuant to the requirements of said Code, appointed Thursday, the 10th day of November, 1966, at the hour of 7:30 o'clock P.M., of said day in the City Hall, South Lake Tahoe, California, as the time and place for hearing protests in relation to said proposed acquisitions and improvements, and directing the Secretary of said District to give notice of said hearing as required by said Code; WHEREAS, it appears that notices of said hearing were duly and regularly posted, mailed and published in the time, form and manner required by said Code, as evidenced by the affidavits on file with said Secretary, whereupon said hearing was duly and regularly held at the time and place stated in said notice; and WHEREAS, persons interested~ objecting to said acquisitions and improvements, or to the extent of the assessment district, or to the grades at which said work will be done, or to the Engineer's estimate of the cost and expenses thereof, or to the issuance of bonds or to the formation of the zone or the extent thereof, filed written protests with the Secretary of said District at or before the time set for hearing, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters and things pertaining to said acquisitions and improvements were fully heard and considered by said Board, and said Board thereupon adopted its Resolution No.~, A Resolution Overruling Protests on Reso- lution of Intention No. 723. NOW, THEREFORE, said Board does hereby FIND, DETERMINE and ORDER, as follows: 1. That the owners of one-half of the area to be assessed for the cost of the project did not, at or prior to the time fixed for said hearing file written protests against the said proposed acqui- sitions and improvements as a whole, or against the said zone or the extent thereof to be assessed for the costs and expenses of said acquisitions and improvements as a whole~ or as to the Engineer's estimate of said costs and expenses, or against the issuance of bonds to pay for the costs and expenses thereof. 2. That the zone benefited by said acquisitions and improve- ments and to be assessed to pay the costs and expenses thereof, and the principal and interest on said bonds, and the exterior bounda- ries thereof are more particularly described in said Resolution of Intention and made a part hereof by reference thereto. That all public streets, highways, lanes and alleys and other publicly owned and otherwise non-taxable property within said zone shall be omitted from the annual ad valorem assessments hereafter to be made to pay principal and interest on bonds. 3. That the plans and specifications for the proposed improve- ments, contained in said report, be, and they are hereby, finally adopted and approved as the plans and specifications to which said work shall be done as called for in said Resolution of Intention. 4. That the Engineer's estimate of the itemized and total costs and expenses of said acquisitions and improvements, and of the incidental expenses in connection therewith, contained in said re- port~ be, and it is hereby, finally adopted and approved as the Engineer's total and detailed estimate of the costs and expenses of said acquisitions and improvements. 5. That the public interest, convenience and necessity deman~ need and require~ and said Board does hereby order the acquisitions and improvements to be made as described in and in accordance with said Resolution of Intention on file in the office of the Secretary of said District, reference to which is hereby made for a more par- ticular description of said acquisitions and improvements, and also for further particulars pursuant to the provisions of said Code. 6. That the maps and descriptions of lands, rights of way and easements necessary to be acquired in order to construct said improvements, contained in said report, be~ and the same are hereby~ finally approved and confirmed. 7. That said Engineer's report, be, and the same is hereby, finally adopted and approved as a whole. 8. That in the opinion of this Board all of the property con- tained within said proposed zone will be benefited by the formation thereof and by the acquisition and construction of the improvements as proposed~ and said area is hereby declared formed into a zone pursuant to Division 7 of the Public Utilities Code of the State of ""e , California, to be called the ~ yers Area Sewer Project 2one" for the purposes of financing the cost of said acquisitions and improve- ments as proposed in said Resolution of Intention. 9. That~ subject to the results of the election to be here- after called and held within the boundaries of said zone, bonds shall be issued in the amount of not to exceed $2,925,000, to finance said acquisitions and improvements and all expenses incidental t~here- to~ jurisdiction to issue which is hereby reserved. 10. That the boundaries of said zone are more particularly described in Exhibit "A" hereto attached and incorporated herein by reference. ll. That filings pursuant to Section 54900, et seq. of the Government Code of the State of California~ of the formation of the Meyers Area Sewer Project Zone, shall be made with each the County Assessor of the County of E1 Dorado and the State Board of Equali- zation.
