Resolution No. 3054-17 Tahoe Keys Emergency Action1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 RESOLUTION NO. 3054-17 A RESOLUTION OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT DECLARING AN EMERGENCY, AUTHORIZING CONTRACTS WITHOUT BIDS, DELEGATING AUTHORITY TO ORDER EMERGENCY ACTION, AND DETERMINING CALIFORNIA ENVIRONMENTAL QUALITY ACT EXEMPTION WHEREAS, the South Tahoe Public Utility District ("District") is engaged in the collection, treatment and disposal of wastewater to its customers; and, WHEREAS, a District sewer pipeline runs through Tahoe Keys Boulevard, to and from a manhole identified as TK1, also located in Tahoe Keys Boulevard, with a sewer pipe continuing from said manhole into the Tahoe Keys Pump Station and, WHEREAS, this pipeline segment from TKl to the Pump Station is 80 feet long, 57 years old, comprised of 24 -inch AC pipe, and has experienced a failure of unknown length and severity; and WHEREAS, this sewer pipeline failure has caused a road collapse and sinkhole as well as operational problems with the sewage collection system, and risk of system failure and sewage spill; and WHEREAS, groundwater, depth of excavation, and deficient backfill material has amplified the complexity of the response, and which requires immediate assistance beyond existing District resources, WHEREAS, in accordance with Public Contract Code Section 22050, substantial evidence has been provided to the District, which demonstrates immediate action is necessary to prevent this loss or impairment, repair these facilities, and enter into Agreements with contractors to design and perform such repair necessary to maintain service, which will not permit a delay resulting from competitive solicitation for bids and this action is necessary to respond to the emergency; and, WHEREAS, emergency projects are exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 relating to existing facilities. in 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 NOW, THEREFORE BE IT RESOLVED AS FOLLOWS: 1. The damage to the Tahoe Keys Street sewer pipeline is an unexpected occurrence that poses a clear and imminent danger, which could lead to the loss or impairment of health, property and essential services, and therefore constitute an emergency, pursuant to Section 1 102 of the Public Contract Code. 2. Immediate action directly related to the emergency, including protection to the pipeline and action to procure the necessary equipment, services and supplies is necessary to respond to the emergency, which will not permit a delay resulting from competitive solicitation for bids and this action is necessary to respond to the emergency. 3. The General Manager/Engineer and Assistant General Manager/Engineer of the District are hereby authorized and directed to order any action necessary and appropriate to respond to the emergency including repair and/or replacement of the pipeline, and the procurement of any necessary equipment, services and supplies, without giving notice for competitive bids to let contracts. 4. Emergency repairs related to the replacement of the pipeline is necessary to maintain service and repair actions are necessary to mitigate the emergency are thus exempt from the requirements of CEQA pursuant to Public Resources Code section 21080(b) (2) and (4) relating to emergencies and existing I facilities. 5. File a CEQA Notice of Exemption 6. Approve expenditures necessary to start emergency repairs of up to $100,000 7.
