Resolution No. 859WJML~RJH~gbb 6/19/67 10c RESOLUTION NO. 8 5 9 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO APPROPRIATE SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS OR OTHER APPROPRIATE PRO- CEEDINGS, FOR THE ACQUISITIONAND CONSTRUCTION OF A SANITARY SEWERAGE SYSTEM AND APPURTENANCES WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE ASSESSMENT DISTRICT 1967~1 RESOLVED, by the Board of Directors of the South Tahoe Pub- lic Utility District, E1 Dorado County, California, that WHEREAS, the Health Officer of E1 Dorado County and Ex- 'officio Health Officer of the City of South Lake Tahoe has recom- mended to this Board as necessary as a health measure, which rec- ommendation was given in writing and signed by him, that it undertake appropriate special assessment and assessment bond proceedings for the acquisition and construction of a sanitary sewerage system in said District, said acquisitions and improvements being more particu- larly described in Exhibit A attached hereto and incorporated herein. WHEREAS, the cost of said project will be assessed upon the district benefited thereby, the exterior boundaries of which are the coterminous exterior boundaries of the composite and consolidated area more particularly shown on the map thereof on file in the of- fice of the Clerk of said District; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED as follows: lo That a copy of said Health Officer's letter be spread upon the minutes of this meeting. 2. That said proceedings so proposed to be undertaken by this Board for the acquisition and construction of said sanitary sewerage system are necessary as a health measure° 3. That the provisions of Division 4 of the Streets and High- ways Code are hereby dispensed with and no longer apply to said pro- ceedings o ATI~&"I~ ~'/~ /~ f // / ~erk ~d Ex-officio Secretary President South Tahoe Public Utility District Ao The installation and construction of sanitary sewer systems, in- cluding collection sewers, force mains, manholes, flushing devices, rod- holes,~ wye branches and laterals on streets and roads and in easements to be acquired therefor, within the boundaries of each of the following areas, to wit~ (1) Area known as and shown upon that certain map entitled "Mountain View Estates, Unit 5", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 81; (2) Area known as and shown upon that certain map entitled "Mountain View Estates, Unit 6", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 82; (3) Area known as and shown upon that certain map entitled "Mountain View Estates, Unit ?", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 28; (4) Area known as and shown upon that certain map entitled "Mountain View Estates, Unit 8", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 43; ~ (5) Area known as and shown upon that certain map entitled "Mountain View Estates, Unit 10", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 66; (6) Area knOWn as and shown upon that certain map entitled "Echo View Estates, Unit l", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 44; (7) Area known as and shown upon that certain map entitled "Echo View Estates, Unit 2", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 14; (8) Area designated as Assessor's No. 33-02-12, being parcel No. 12 as shown in Book 33 at page 2 of the Assessor's Maps of the County Assessor, E1 Dorado County, California; (9) Area known as and shown upon that certain map entitled "Country Club Estates, Unit l" excepting therefrom, however, lots 19 through 22 and 60 through 6~, both inclusive, which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 87; (10) Area known as and shown upon that certain map entitled "Country Club Estates, Unit 2," which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 99; (11) Area known as and shown upon that certain map entitled "Country Club Heights, Unit l", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Nap Book C at page 19, except lot 5 thereof; (12) Area known as and shown upon that certain map entitled "Country Club Heights, Unit 2", which map is filed in the office EXHIBIT A South Tahoe Public Utility.District Assessment District 19hZ-1 of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 20; (13) Area known as and shown upon that certain map entitled "Country Club Heights, Unit 3", which map is filed in the office of the County Recorder of E1 Dorado County, State of California, in Map Book C at page 40; (14) Parcel designated as Assessor's NOo 33-191-4, being par- cel Noo 4 as shown in Book 33 at page 191 of the Assessor's Maps of the County AssessOr, E1 Dorado County, California; (15) Area known as "Lake Valley Ranger Station," as described in that certain instrument recorded in Book 155 at page 52 in the office of the County Recorder of E1 Dorado County, State of California; (16) Area along, adjacent to and on both sides of UoS, High- way Noo 50 between~Pioneer Trail and State Highway No. 89, which area includes the following: (a) All parcels within Tahoe Paradise Unit 18 as shown upon that certain map filed in the office of the County Re- corder of E1 Dorado County, State of California, in Map Book C at page 50; (b) All parcels within Tahoe Paradise Unit 1SA as shown upon that certain map filed in the office of the County Re- corder of E1 Dorado County, State of California, in Map Book D at page 53; (c) All parcels within Tahoe Paradise Unit 34 as shown upon that certain map filed in the office of the County Re- corder of E1 Dorado County, State of California, in Map Book D at page 15; (d) Lots B, C, D, E, F~ G~ H and I in Tahoe Paradise Unit 15 as shown upon that certain map filed in the office of the County Recorder of E1 Dorado County, State of Cali- fornia, in Map Book C at page 12; (e) Parcel Nos. 10, ll, 12, 13 and 14 as shown on that certain "Record of Survey" filed in the office of the County Recorder of E1 Dorado~County, State of California, in Book 1 at page 85; (f) Parcel designated as Assessor's No. 34-27-29, being parcel NOo 29 as shown in Book 34 at page 27 of the Assessor's Maps of the County Assessor, E1 Dorado County, California; (g) Parcel designated as Assessor's No. 34-27-32, being parcel NOo 32 as shown in Book 34 at page 27 of the Assessor's Maps of the County Assessor, E1 Dorado County, California; Bo The acquisition within the boundaries of each of the above de- scribed areas of a right of service and use in the existing sanitary Sewerage and sewage treatment and disposal facilities of said District which'help provide service to and which are of benefit to the proper- ties within said areas; C. The acquisition of all facilities, lands and easements and the construction of all work auxiliary to any of the above and neces- sary to complete the same.
