Mr. Stanley and Mr. Doug Van Gorden performed a site visit to the leak area on January 9, 2002 following a report of a possible water leak. It is the determination of the District staffthat the water leak was confined to a crack in the asphalt and no water or silt was seen to be pushing out of this crack and that the repair to this minor leak could be completed on January I0, 2002. Due to substantial runoff and freezing snow melt, similar icy conditions were found throughout the town that morning. That being the case, the District is reluctant to assume liability for a condition that was likely a natural occurrence in winter weather. The District is willing to take appropriate responsibility for problems caused by our activities, but will not assame respousibility for problems that are not of our mak/ng. P,'tCUST_SVC~Claim form.wpd To: From: Date: Subject: Lisa Coyner Chris Stanley January 15, 2002 Accident on Lake Tahoe Blvd. & Glorene On Wed nesday, January 9th, the District received a report of a possible water leak on Lake Tahoe Blvd. and Glorene. Mark Connell, the District's water service person, verified that there was a leak in the number 2 westbound lane of Lake Tahoe Blvd. Knowing that we had a full crew working on Thursday, January 10~ to repair the leak, emergency digs was called to mark the area. Chris Stanley and Doug Van Gorden checked on the leak at 4:30 p.m. on Wednesday. The leak didn't appear to be causing any problems at that time. The water was confined to a crack in the asphalt. No silt or water was seen to be pushing out of this crack. The water was not running across the pavement to the side of the road. It is our assumption that vehicles driving over the crack splashed water onto the roadway, causing black ice. The dewaterinq facilities will be located on the plant property and the access road will traverse two contiguous District parcels. These two parcels are part of a planninq area desiqnated bv TRPA for recreation and mitiqation/ restoration. Due to time constraints and the additional complexities involved in permittinq the proiect in these areas, staff is requestinq assistance from Parsons. Parsons is also handlinq the environmental documentation for the adiacent ballflelds proiect. Since our proiect has some of the same permittinq issues, we will see some time and cost benefits by usinq Parsons. As detailed on the attachment, the proposed work to be completed by Parsons includes the preparation of an Expanded Initial Study and Environmental Checklist, a Forest Manaqement Plan, and a Negative Declaration. SCOPE OF WORK The scope of work is outlined in the Consultant's proposal of February 12, 2002, contained and outlined as Tasks 1 through 4. This proposal becomes apart of this Task Order by reference herein. 3. STAFFING Staffing will be under the direction of Anders J. Hauge, Principal in Charge, Robert Brueck, Principal Planner, Krishna Nand, Air Quality Specialist, Adam Ballard, Associate Scientist, Christy Consolini, Associate Planner, and Bryan Fergus6n, CADD. CONSULTANT will not change staffing without approval by DISTRICT. Any changes shall provide for equivalent qualifications as far as possible and practical. 4. TIME OF PERFORMANCE CONSULTANT estimates completion of the Initial Study within 10 weeks of District authorization, assuming timely review of the draft products by the District and its attorneys. Board adoption and TRPA permit approval will be dependent upon District and TRPA review times for the permit application and Draft Initial Study/IEC. 5. PAYMENT Payment to CONSULTANT for services performed under this Task Order shall be as provided in Article IV of the Master Non-Grant Agreement. The cost cei[ing for this Task Order is Sixteen Thousand Dollars ($16,000.00) as outlined in CONSULTANT's proposal and wil] not be exceeded except as provided in Article IV of the Master Agreement. 6. In order to prepare the scope of work provided below, I have made the following assumptions: · A Negative Declaration will be the appropriate CEQA document; · An Initial Evaluation Checklist (IEC) will be the appropriate TRPA document; · STPUD will prepare the site plans and land coverage calculations necessary for the project description and TRPA permit application; ,, Timber harvesting will be addressed by a one-time exemption prepared by J. Hoefer; · No new biological or cultural resources surveys will be required; and · Parsons will not attend any public heatings. SCOPE OFWORK Task 1 Review Background Information and Prepare Project Description Parsons will visit the site and attend a kick-off meeting (February 22, 2002), collect available background information about the site vicinity from the District, and review any enx;ironmental documents prepared for other projects in the immediate vicinity. Parsons will obtain base maps and a general description of the proposed action from the District, and shall prepare a project description/map that is of adequate detail for use in the TRPA application and Negative Declaration. Task 2 TRPA Permit Application Parsons shall use the description of the project prepared in Task 1 to prepare the TRPA permit application. The TRPA permit applic~ation shall include: · acompleted application form; 'Mr. John Thiel February 12, 2002 Page 2 · an application fee ($1,610 - to be paid by the District); · stamped notification envelopes for properties within 300 feet of the project site (to be prepared by the District); · a map of the project area; · the detailed site plan drawing with 2 foot contours and tree locations and sizes; · a land coverage calculation matrix; and · a Draft IEC (see Task 3 for additional work on the IEC). The District shall provide the necessary site plans and land coverage calculationsT' The TRPA application will be provided to the District for signature, and then delivered to TRPA by the District. TRPA shall determine if the application is complete. If additional information is requested by TRPA, TRPA will prepare a letter within 30 days requesting the additional application materials. Parsons will work with the District to provide the requested information within 14 days from receipt of the TRPA letter. Task 3 Prepare Initial Study/IEC Parsons shall use the description of the project prepared in Tasks 1 and 2 to prepare the Expanded Initial Study/EEC. The document shall provide: · a description of the project; · the location of the project; · a proposed finding that the project will not have a significant effect on the environment; · an attached copy of the Initial Study/1EC documenting reasons to support the finding; and · mitigation measures, if any, included in the project to avoid potentially significant effects. The completed Initial Study/lEC shall be prepared for review by the District and TRPA. Issues that are anticipated to be addressed in detail include: · biological resources (including habitat loss and forest enhancement - TRPA has stated that they will want a detailed forest restoration plan for the parcel east of the WWTP); · land use (consistency with TRPA Plan Area); · grading/water quality (adequacy of temporary and permanent BMPs - TRPA-has stated that they will want an analysis of existing BMPs at the WWTP); · land coverage (analysis of land coverage by parcel and new project area), · public health and safety (relocated track traffic and hazardous materials transportation); · air quality (relationship of VMT associated with track trips to the removal of the incinerator); and · traffic (refer to analysis prepared for the El Dorado County play fields project). Following revisions, Parsons shall produce up to 40 copies of a Notice to Adopt a Negative ,Declaration (including the Initial Study/IEC as an attachment) and circulate it to the State Office of Planning and Research and other interested agencies and members of the public. At the same time as circulation begins, the Negative Declaration will be noticed in the Tahoe Tribune. Mr. John Thiel February 12, 2002 Page 3 Task 4 Final Environmental Documentation Following the circulation of the Negative Declaration, a Final Environmental Documentation package will be prepared and taken to the District Board for approval. Parsons assumes that no more than 20 comments will be received on the Negative Declaration. Once the Board has approved the project, a Notice of Determination shall be prepared and sent to the E1 Dorado County Clerks office for 30-day posting. The filing of a Notice of Determ/nation starts a 30-day statute of limitations on court challenges to the District's approval under CEQA. For budgeting purposes, it is assumed that the project will not result in any wildlife habitat .m, odifications. Therefore, no Fish and Game impact fees have been budgeted. SCHEDULE Preparation of the project description, TRPA application, and Draft IS/IEC will be completed within 10 weeks of District authorization. Board adoption and TRPA permit approval will be dependent upon District and TRPA review times for the permit application and Draft Initial Study/IEC. Additionally, the District wishes to install a control strategy that will allow them to revise the automatic operation of the effluent pumping system so that it more closely follows the off-peak electrical rates promulgated by Sierra Pacific Power during periods when the grant requirements do not apply. OBJECTIVES · Meet requirements of grant (reduce demand 2-6 p.m. weekdays during summer months) · Reduce demand charges at Luther Pass (the rest of the year) · Keep pump starts to a minimum · Provide for emergency circumstances (override) PROJECTTASKS The following Tasks are included in the Scope of Services for this analysis. There are a number of uncertainties concerning existing equipment and the methods of interfacing to their controls. Several assumptions have been made regarding the methods of interfacing that will be required. Task 2 (below) will ultimately determine whether the assumptions made are correct. Additional effort beyond that shown within this Scope of Work may be required depending on currently unknown electrical requirements and the potential need for additional drawings (Task 3) and additional programming work (Task 5). Task I - Existing Controls and Hardware Engineer will review the existing control systems for the Luther Pass, Filter Influent and the treatment plant Effluent Pumping Stations and the hardware and software used to make them work. This will include one site visit to inspect the existing hardware and working with District staff to understand exactly how the existing system is operated. Engineer will develop a-simple diagram and brief narrative text describing the existing control scheme and identifying the hardware being used. Deliverable: Diagram and description establishing how the system is currently operated and the hardware that is used in that operation. District Provided Information: Existing system control diagrams and information on the existing hardware and software being used. Task 2 - New Control Strategy Engineer shall develop a new control strategy to be used to operate the export system that will allow the District to meet the requirements of the grant, reduce demand charges when the grant conditions are not applicable, and provide for future flexibility in operating the export system. Plant operations that will be controlled by the new program include: 1. Treatment plant export pumps 2. Luther Pass Pump Station export pumps 3. Filter pumps 4. Storage ponds at the treatment plant. 5. Storage tank at Luther Pass Development of the new control strategy will also include the identification of which of the existing components in the export system would be used in the new control program and identification of new hardware that would be required. The evaluation of the existing components will include considerations of whether or not the use of the existing components will "limit" the flexibility of the control program in the future. For example, will the existing components work to implement the immediate strategy of limiting export system operation during the four hour grant identified window and to address changes that may be desired after the three year grant window expires. The new control strategy must accomplish the following: Control final pumping rates, and anticipate future dally shutdown needs by emptying available storage. Control filter influent pumps based on final pump control. Limit Luther Pass Pump Station demand during peak hours. Log Luther Pass Pump Station power usage. The control system needs to provide time of day (15 min. increments), day of week, month of year, and "special day" (holiday, emergency override) programming. The system needs to select from at least seven different Luther Pass pumping states: one 700 hp pump, one 1000 hp pump, two 700 hp pumps, one 700hp & one 1000hp, two 1000 hp pumps, two 700hp pumps & one 1000 hp pump, and two 1000 hp pumps and one 700 hp pump. Following the submittal of bids, engineer will assist the District, at District request, with the evaluation of the bids and identification of the apparent Iow bid contractor. The work to be completed under this task includes: · Answering questions routed from the District during the Bid process. · Preparation of two addenda (if required) Task 5 - Control Programming Engineer will provide programming services necessary to implement the control strategy on hardware provided and installed by the contractor. Engineer will develop the program (including appropriate documentation), test the program prior to installation, and install the program prior to shipment of hardware to the field. Engineer will train District operations staff on the use of the new system and program. Engineer will perform field startup and testing to insure that the above identified goals have been achieved and perform follow-up services. Startup and trouble shooting is expected to take approximately three days. Follow-up services will include correction of any deficiencies discovered within one year of system startup, plus one follow-up visit for supplementary staff training. Robert Ducheck/Parsons, gave an overhead slide pre- sentation that gave an overview of the EIR, and covered the plan's components and alternatives. Bill Morqan/Alpine County Planninq Commission, requested that the Board clarify their preferred alternative from the five presented. Mark DiMiao/Alpine County Engineer, on behalf of the Alpine County Board of Supervisors, requested a two-week extension on the comment period for the EIR. Alpine County staff needs more time to address their concerns with some of the proposed alternatives. Julie Harris/Alpine County Children Services, commented on the application of fresh water to the Fredericksburg ditch system. John Cassidy/Alpine County Planninq Commission, expressed concerns about the possible changes in Diamond Valley under under the Ma~ter Plan. He would like to see the area remain as it is. Clint Cielo/Rancher, requested a general breakdown of budget costs for the various alternatives listed in the EIR, and a breakdown of exactly how much land the District will need to apply the maximum amount of water annually. He stated the Board should consider the PUBLIC HEARING PAGE - 3 ramifications of the purchase of the Heise property through condemnation, and the ramifications of dis- continuing water application to existing users. SECTION 1. PURPOSE OF AGREEMENT The purpose of this agreement is to obtain the services of DRI to provide teclmical support for ~vater quali .fy issues related to the Total Maximum Da/iv Load (TMDL) program and South Tahoe Public Utility District (STPUD) project in Alpine CoUnty, based on the proposal submitted by DRI in January 2002. The scope of services to be provided as set forth in Attackment A, which is incorporated herein by reference. SECTION 2. TERM The term of this agreement is for the period February 1, 2002 to January 31, 2003, inclusive, and is renewable armually, at County' s option, under terms to be negotiated between the parties. SECTION 3. COMPENSATION County agrees to pay DRI a sam of $23,586 for the term of this contract for the services contemplated in the scope of services, which includes all claims for labor, laboratory and other expenses, and materials for the monitoring program, and based on the cost rates established in the proposal submitted by DRI in January 2002. Payment will be made to DRI within thirty days of submission of invoice to the~Alpine County Health Department and upon review by the Alpine County Health Officer as to required tasks, and submitted to the Alpine County Auditor. Claims shall be submitted no less than quarterly, unless expressly agreed by both parties. Contract No. P~e No.2 Coumy agrees that if County requests services not specified in the scope of services described within this agreement, County will pay for ail such services as extra work. Normal correspondence is included in the proposai estimate, DRI will obtain the written consent of County prior to undertaking any serv/ces which exceed those specified in the proposai and scope of services. SECTION 4. TERMINATION OF CONTRACT County may terminate this _agreement and be relieved of the payment of any consideration to DRI should DRI fail in any materiai performance of the covenants herein contained at the time and the manner herein provided. In the event of such termination, County may proceed with the work in any manner deemed proper by County. The cost to County will be deducted from any sum due DR/under this agreement, and the balance, if any, will be paid to DRI upon demand. The parties acknowledge tt~ the participation of County in this agreement is funded by separate and independent agreement between County and the South Tahoe Public Utility District (STPUD). In the event STPUD funding is not available, for any reason, County may terminate this agreement in ~witing. SECTION 5. INDEPENDENT CONTRACTOR STATUS It is the intent of the parties that DRI is an independent contractor and not an employee of County. This agreement excludes absolutely any employee-employer relationship between DRI and County. County will not provide workers' compensation, nor pay state disability, unemployment insurance benefits, or social security, or any other costs, compensation or benefits not expressly set forth herein for DRI under this agreement. DRI will be fully responsible for paying federal and state income tax responsibilities, social security and any other payroll obligations that DR/may owe as a result of compensation received under this agreement. SECTION 6. DISCRIMINATION IN EMPLOYMENT PROHIBITED DRI warrants that ail of their employees and applicants will receive equal consideration and treatment in employment without regard to race, color, religion, ancestry, nationai or/gin, age, sex, sexuai preference, martial stabs, and medicai condition or physical disability which does not preclude the employee or applicant's ability to perform the job as defined in the job description with reasonable accommodations. TI-tis document describes the scope of work and associated costs proposed by DRI in support of this effort. The cost to complete all five tasks is $23,586. Task 1. Characterization and analysis of mass loading of phosphorus in surface waters. To adequately characterize the mass flux of phosphorus throughout the watershed, k is important to measure flow as well as concen~ation. DRI staff will accompany STPUD on their monthly surface-water sampling hms and measure flow. We will use STPUD's published values of phosphorus concentrations to determine flux rates at each location. The cost for this task is $11,268. Task 2. Field Monitoring in Support of Quality Assurance Program DRI will conduct routine field monitoring during the fall of 2001. This task will consist of sampling and analysis of groundwater, surface water, and soil samples in support of the Alpine County quality assurance program. Samples wilt be taken in coordination with STPUD sampling and will use identical, standard sampling procedures. Cost for this task is $6,987. Soil samples will be collected from six sites (S-2, S-3, S-4, S-5, S-6, S-7) and analyzed at the DRI Water Laboratory for TKN, NO3-N, Total P, and Ortho-P. Groundwater: Groundwater samples will be collected from four sites (ACMW-1AW, ACMW- 4W, GW-4, GW-11) and analyzed for TKN, NO3-N, Total P, and Ortho-P. Surface water samples will be collected from four sites (SW-2, SW-4, SW-5, SW- 6) and analyzed for TKN, NO~-N, Total P, and Ortho-P. Task 3. MTBE Characterization DRI will cominue monitoring for MTBE contamination related to the wastewater reuse program. Samples w/Il be taken in Harvey Place Reservoir, monitoring wells down-gradient of the reservoir (ACMW1, ACMW-1AW), and in one or two ditches in Diamond Valley. Cost for this task is $1,168. Task 4. Analysis of Nitrogen Isotope Samples Because of delays in the analysis of the nitrogen samples taken under the previous contract, we request that the laboratory costs be charged under the current contrac~t. The part-time position is not adequate to perform the amount of administrative support duties required in the department, which is also responsible for Safety and Risk Management. Additionally, District demoqraphics indicate that the number of retirees in the next five to ten years will increase dramatically, thereby increasing the number of recruitments, with correspondinq administrative support, needed each year. The average ratio of human resources staff to number of aqency employees is 1:49. With a full-time Human Resources Coordinator, the District's ratio would be 1:54. Staff is proposinq to delete previously budqeted positions of Grant Financial Administrator and Equipment Repair Person. Grant Financial Administrator duties are beinq performed by an outside contractor. The Equipment Repair department may be able to contract out some routine maintenance duties, which may eliminate the need for additional staff. Budqet analysis (includinq benefits costs at approximately 37% of salary) of the proposed staffinq chanqes results in an increase to the salary and benefit budqet of $30,284 per year, and a decrease in the construction budqet of approximately $115,000 per year, with an overall budqet savinqs of approximately $85,000 per year.
