from this office, will make .fan inspection of the proposed
projects under your above -numbered applications on the 1st
day of September, 1959. Ile "will be at Myers Post Office at
about 8:30 a.m. on that date and will meet you or your repre
sentative at that time and place.
It is important that you bei -present or page a
representative who is familiar with your proposed` pro ject: and
anticipated use of water. Any records that you: might have
relative to use of water and flow of water in the source
should be available at that time.
Please return the enclosed card at your early
convenience, indicating if you can keep the appointment or
who will represent you. It is requested that no change be
made, as field trips are closely scheduled.

In response to your letter of April 30 in connection with
the above numbered application of Meyers Water Company to appropri-
ate from Saxon Creek, please be advised that Application 18021 is
still pending before this office and no immediate action on the
filing is contemplated. If and when a hearing is held in connection
with`the application, you and Mr. Leonard will be notified suffi-
ciently in advance of the time and place.
No additional applications to appropriate from Saxon Creek
have been filed since July 31, 1958. Your name along with that of
Mr. Richard M. Leonard has been placed upon our records to receive
notice of any new applications which may be filed to appropriate

The writer conferred with Mr. Spencer and Mr.
Jopson on the above date regarding the procedure to be
followed in inviting stipulations in connection with
protested applications within all watersheds under Cali-
fornia -Nevada Compact Commission jurisdiction. It was
concluded that following receipt of answers to protests,
applications would be routed to Mr. Woodward for field
investigation and report on physical facts, which report
would also recommend hearing procedure to be followed.
A copy of the report should be forwarded to California -
Nevada Compact Commission informing them of our recommenda-
tion for either formal hearing or proceedings in lieu of.
hearing. We should then suspend action for 90 days within
which the Commission may give its views; Upon expiration
of the 90 -day period, stipulations may be invited or action
may be taken to set a formal hearing if no adverse response
has been received.

1958,, advising that because of special problems in connec-
tion with the sources involved under the above -numbered
applications you do not believe that the proceedings in
lieu of hearing will be satisfactory in this particular
instance. The matter will therefore be referred for hear-
ing before the Board in due course.
If in the meantime, the Department of Fish and
Game through negotiations with the applicant is able to
resolve the matter through agreement and thus obviate the
necessity of a hearing, we would appreciate being advised.
