M. Page, Supervisor Central Region Re: Application #23502 Gentlemen: This letter is in reply to the protest filed by the Bureau of Reclamation for the above named application. The protester states he would be willing to dismiss his protest if we were to agree to certain conditions listed on his protest. We have absolutely no intention of agreeing to such conditions. He states we would be junior in priority to all other water rights filed simply because of date of filing. We believe the highest degree of beneficial use is a higher priority and therefore leave this decision to the wise judgement of the control board itself. We also believe there are many permits in existance in which a portion, and in some cases a large portion, of the water is not being utilized and never will be. There is also the consideration of the needs for domestic drinIstegg water versus recreational and wildlife needs. Again, these matters we leave to the judgement of the board. M. Page, Supervisor Central Region Re: Application #23502 Dear Mr. Page: On October 19th I visited your office and talked with Mr. Archie Chelisler and Mr. Ben Rinehart. Mr. Che#sler informed me that it would probably be at least a year before we get a decision on application #23502 or the 5 various petitions filed by Tahoe Paradise Water & Gas Co. This timing is going to prove very critical to us financially. We had hoped we would have a decision on the 5 various petitions to move point of diversion and change place of use much earlier than that. If it does take a year, we are in all probability going to be faced with having to spend funds on new facilities we had hoped would not be necessary. These funds, of course, are going to come out of those we have earmarked for the pointof diversion and pipelines.
