Thank you for meeting with Steve Marquez, Matt McCarthy and me on 2/8/2018 to
discuss STPUD's pending water rights actions.
In this email I would like to follow-up on our discussion regarding STPUD's pending
water rights applications. Below you will find a review of some of the options available
to you in terms of processing the applications. Please review the options and let me
know how you plan to proceed.
(1) Continue processing the application. To continue processing the application
without delay please submit the supplemental information requested in the
SWRCB's January 12, 2018 letter. Please submit the requested supplemental
information for each application by May 1, 2018.
(2) Request to put the application on hold. Per our discussion during our meeting
earlier this month you have the option to request that the SWRCB delay
processing of the application. If the request is granted, the application will be
assessed annual fees and the SWRCB will review the decision to grant the
request to delay processing of the application on an annual basis.
If you would like to make this request, please submit your request in writing
with a list of the application(s) subject to the request and a brief statement for
each application explaining why the request is being made.
(3) Cancel the application. To cancel an application(s) please submit a Request for
Cancellation of Water Right Application available on the SWRCB's website at:

pending water right application and/or petition included in the enclosed list.
The State Water Resources Control Board, Division of WaterRights (Division) has'determined
that the water right applications and petitions included in the enclosed list require either
(1) issuance of a notice or (2) issuance of a new notice because the records do not reflect up -to
date circumstances. (Cal. Code Regs., tit. 23, § 684.) The changed circumstances include the
fact that on December 1, 2015, the federal Water Master began implementing the Truckee River
Operating Agreement and the interstate allocations under the 1990 Truckee -Carson -Pyramid
Lake Water Rights Settlement Act took effect.
The purpose of this letter is to (1) inform you that the Division intends to issue a notice of your
water right application and/or petition and (2) request information to supplement your.water right
application and/or petition to ensure your application and/or petition reflects up-to-date
circumstances for noticing purposes. .

WITHIN THE LAKE TAHOE AND TRUCKEE RIVER BASINS — INFORMATION REQUEST
The California State Water Resources Control Board (State Water Board), Division of Water
Rights (Division), is the agency responsible for administering surface water rights in California.
The purpose of this letter is, to request information necessary to update the Division's records
regarding pending Applications to Appropriate Water by Permit in the Lake Tahoe and Truckee
River Basins. You have received this letter because our records show that the persons Iisted on
the attached mailing list have a pending water right application on file with the Division for water
projects within the Lake Tahoe and Truckee River Basins. •
Background
The interstate waters of the Lake Tahoe and Truckee River Basins have been the subject of
dispute, controversy, and litigation for well over a century. These conflicts have now been
addressed with federal legislation, the 1990 Truckee -Carson -Pyramid Lake Water Rights
Settlement Act (Settlement Act), and a negotiated agreement known as the Truckee River
Operating Agreement (TROA) between the State of California, the State of Nevada, the United
States, the Pyramid Lake Paiute Tribe, the Truckee Meadows Water Authority, and other
parties.
The Settlement Act provides for the permanent allocation of water between: the States of.
California and Nevada in the Lake Tahoe, Truckee River, and Carson River Basins. For the
Lake Tahoe Basin, the Settlement Act (Section 204(b)(1)) provides that the total gross
diversions for use within the Lake Tahoe Basin from all natural sources, including groundwater, •
and under all water rights in the basin shall not exceed 34,000 acre-feet per year (AFY). From.
this total, 23,000 AFY is allocated to the State of California for use within the Lake Tahoe Basin.
In the Truckee River Basin, the Settlement Act (Sections 204(c)(1) and 204(c)(1)(A)) allocates
to California the right to divert or extract, or to utilize any combination thereof, the gross amount
of 32,000 AFY from all natural sources, including both surface and groundwater, provided that
the. maximum annual diversion of surface supplies not exceed 10,000 AFY. The Settlement Act
requires each state to assure compliance with these allocations by regularly reporting on water
use.
The primary purpose of TROA is to modify the operation of federal and certain non-federal
reservoirs in the Truckee River Basin for water supply and environmental purposes. The
Settlement Act established the basis for TROA, which was formally signed in 2008, but required
certain conditions to be met before the agreement could be implemented. On
December 1, 2015, the federal Water Master began implementing TROA. With TROA's
implementation, the interstate allocations under the Settlement Act take effect.

Information Required to Update Water Right Application Records
The State Water Board will administer water rights in California assuring that surface water use
is consistent with the Settiernent Act and TROA. With both .the Settlement Act water allocations
and TROA now in effect, the State Water Hoard will initiate a process of evaluating and
prioritizing water rights actions in the basins. However, State Water Board records are likely
outdated since most of the water right applications have been held in abeyance for decades
pending. resolution of the issues addressed in the Settlement Act and TROA. Therefore, the
Division must begin with an update of water rights records by gathering basic factual information
for each record.
