Resolution No. 1194WJML:RJH:gbb 10/11/68 12c RESOLUTION NO. 1 1 9 4 A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS ASSESSMENT DISTRICT 1967-4D RESOLVED, by the Board of Directors of the South Tahoe Public' Utility District, E1 Dorado County, California, that WHEREAS, this Board did on May 16, 1968, pass and adopt its Reso- lution of Intention No. 1076 relating to the acquisition and construc- tion of public improvements in said District under and pursuant to the provisions of the Municipal Improvement Act of 1913, and amendments thereto, and did therein provide that serial bonds would be issued thereunder pursuant to the provisions of the Improvement Bond Act of 1915, reference to said Resolution of Intention hereby being expressly made for further particulars; WHEREAS, notice of the recordation of the assessment and of the time within which assessments may be paid in cash has been duly pub- lished and mailed in the manner provided by law, and the time so pro- vided for receiving the payment of assessments in cash has expired, and the Clerk of said District has filed with the County Treasurer of E1 Dorado County and ex-officio Treasurer of the District a list of all assessments which now remain unpaid; and WHEREAS, the Board has duly considered said list and has deter- mined that the same is an accurate statement thereof; NOW, THEREFORE, IT IS HEREBY ORDERED, as follows: 1. That the assessments in said unpaid list which now remain un- paid, and the aggregate thereof, are as shown on Exhibit A hereto at- tached and by reference made a part hereof. 2. That for a particular description of the lots or parcels of land bearing the respective assessment numbers set forth in said unpaid list and upon which assessments remain unpaid, severally and respectively, reference is hereby made to the assessment and diagram recorded in the office of the District Engineer of said District after confirmation by this Board, the several lots or parcels of land represented by said assessment numbers being so confirmed and recorded, severally and re- spectively. 5. The unpaid list is in the amount of $460,852.00 and bonds shall be issued forthwith upon the security of said unpaid assessment in said amount in accordance with the provisions of the Improvement Bond Act of 1915 (Division l0 of the Streets and Highways Code) and under and pursuant to the provisions of said Resolution of Intention and the proceedings thereunder duly had and taken; that said bonds shall be four hundred sixty-one (461) in number, shall be dated Nov- ember 4, 1968~ and bear interest from their date at the rate of not to exceed six percent (6%) per annum~ and the denomination of said bonds with their respective numbers and dates of maturity are as shown on Exhibit B hereto attached and made a part hereof by reference. 4. Said bonds shall be issued in series, and the unpaid assess- ments as shown on said list filed with the County Treasurer of E1 Dorado County, as ex-officio Treasurer of said District~ and deter- mined by this Board, together with the interest thereon, shall remain and constitute a trust fund for the redemption and payment of said bonds and of the interest which may be due thereon, which unpaid as- sessments shall be taxable in annual series corresponding in number to the number of series of bonds issued, and an annual proportion of each assessment shall be payable in each year preceding the date of the m&~urity for each of the several bonds issued~ and'such proportion of each assessment coming due in any year, together with the annual interest thereon, shall in turn be payable in installments as the gen- eral taxes of said County on real property are payable~ and shall become delinquent at the same time and in the same proportionate amounts and bear the same proportionate penalties for delinquency. 5. The bonds shall be executed on behalf of the District under -2- its official seal by the Clerk and Treasurer of the District, and the interest coupons attached thereto shall be executed by the Treasurer. For such purpose, the Treasurer may use an engraved, printed or litho- graphed facsimile of his signature in lieu of signature by hand. The seal of the District may be affixed to the bonds by printed, litho- graphed or other reproduction thereof; and such signing and sealing of said bonds by said officers, and signing of said coupons by said Treasurer, shall constitute and be a sufficient and binding execution of each and every one of said bonds and coupons thereof respectively. Said bonds shall be substantially in the form set forth in the Improvement Bond Act of 1915. 6. The coupons attached to each of said bonds, and evidencing the interest to accrue thereon, shall be numbered consecutively and be substantially in the following form, to wit: SOUTH TAHOE PUBLIC UTILITY DISTRICT On E1 Dorado County, California, will pay to bearer at Bank of America N.T. & S.A., 19 Main Office, San Francisco, Calif., paying agent of it~ Treasurer, or at correspondent banks in New York, N.Y., and Chicago, Ill., the sum shown hereon, being interest due on Improvement Bond dated November 4, 1968, of SERIES~U. Coupon No. Bond No. ASSESSMENT DISTRICT 1967-4D county Treasurer and Ex-bffici0'DYstrict Treasurer 7. Delivery of this issue of bonds shall be made on November 4, 1968. In the event the engraved, printed or lithographed bonds and coupons are unavailable for delivery on said date, a single printed, typed or otherwise produced bond in the total amount of the series of bonds, payable in the annual serial amounts of the bonds herein described, with interest payable at the times and in the total annual amounts set forth in said single bond, shall be delivered on said date. Said single bond shall be executed on behalf of this District under the official seal by the Clerk and Treasurer of the District, and delivery thereof shall constitute delivery of the entire series. Said single bond shall be registered in the name of the purchaser of said series of bonds, and thereafter when the engraved, printed or lithographed bonds, as hereinbefore provided for,~ are available, the holder of said single bond shall surrender the same in e×change for said engraved, printed or lithographed bonds, payable to bearer, con- stituting said series. 8. The Clerk shall forward a certified c~py of~this Resolution to each, the County Treasurer, County Auditor and Bank of America N. T. & S. A., Corporate Trust Department, 900 Montgomery Street, San Francisco, California.
