Removal of Rick Frost-Hurzel as Responsible Party, Hurzel Properties, LLC, 961 Emerald Bay Road, South Lake Tahoe, El Dorado County, SCP Case No. T6S044, GeoTracker Global ID SL0601790916 Thank you for your letter dated January 28, 2020 RE: 961 Emerald Bay Road (Letter-enclosed). In the Letter, you note Mr. Frost-Hurzel was named as an individual in the August 27, 2019 Notice of Violation and January 10, 2020 Second Notice of Violation
issued by this office. You also indicate that Mr Frost-Hurzel was never an owner of 961
Emerald Bay (Property) and did not operate any business on the Property. As such, you request to remove Mr. Frost-Hurzel as a responsible party. Staff agrees that Mr. Frost-Hurzel in his individual capacity does not need to furnish any
additional information as required by the May 10, 2019 Order to Submit Technical
Report in Accordance with Section 13267 of the California Water Code. However, Hurzel Properties, LLC continues to be named in the Investigative Order. Staff does recognize that the Property was formerly owned by his parents, John and Hattie Hurzel, during the former Norma’s Dry Cleaners operations (1969-1979) and by
various Hurzel family entities including Hurzel Properties, LLC, from 1998 until the
property was sold in 2010 to Trestle South Tahoe LLC. Staff also note that Hattie Hurzel died in June 1998 and John Hurzel died in October 2007. Staff understand Mr. Frost-Hurzel acted as a manager of Hurzel Properties, LLC following the death of John Hurzel until its dissolution, and is the agent for service for Hurzel Properties, LLC. Therefore,
while not responsible in his individual capacity at this time, Mr. Frost-Hurzel will continue
