The referenced language in the COI should be removed as it is inconsistent with the Access
Agreement. On the other hand, if modified to state that it would be used to store non-hazardous
materials that would be alright. Section 3 of the Agreement requires AECOM to provide a
description of the activities and uses that they intend to use the property. In the notice, you could
require them to more specifically describe the materials they would like to store and confirm that
they are non-hazardous. If there is any chance the materials could contain hazardous materials, the
District should require AECOM to provide environmental insurance coverage through another policy.

Hi Gary-
The “Description of Operations” fine print at the bottom of the Coverages table includes “to store
field equipment and industrial derived waste storage…” The Access Agreement was written for the
temporary storage of equipment and material needed to perform the Plume Characterization; it
does not include temporary storage of wastes.
Will the requested insurance in Section 5 cover clean-up costs in case AECOM brings contaminated
material onto the Tata Well Site property? Should this language be removed from the Certs of
Insurance?

Attached is an updated draft of the 2019 Access Agreement with the appropriate date changes for
the upcoming 2020 field season.
Please provide the Certificates of Insurance showing the requested coverages in Section 5 and
complete the Contact Information required in Section 10. 2.
If possible, please reply with the insurance certificates for our review to finalize the Agreement by
next Tuesday, June 16th. I will then be able to bring the Agreement for acceptance by our Board at
the June 18th Regular Meeting.

Our mobilization to the site is scheduled for the week of July 6, and we anticipate demobilization by
October 20 for a required access of 4 months. Will the access fee remain at the 2019 rate of
$500/per month?
