GRANT OF EASEMENT
FOR�ALUABLE CONSIDERATION,receipt of which is,hereby acknowledged, YNEZ
TAGGART KP.TES,JAMES M. T�iGGART and I3EA i RICIE M. TACii`iART,individuaily anc[as
Trustee of the BEATRICE TAGGART TRUST dated May 27, 1999 (collectively,"Grantor"),hereby
grant to SOUTH TAHOE PUBLIC UTILITY DISTRICT("Grantee"),effective February 1,2013
("Effective Date"):
1. A permanent non-exclusive ten-foot(10')wide underground sewer utility easement as
described in Exhibit A attached hereto and incorporated by reference.
2. An additional five-foot(5')wide maintenance and access easement adjacent and parallel
to the said permanent easement,all as is described in E�ibit A.
3. An easement for an underground tank and pump as described in E�ibit A.
The foregoing easements,which are referred to hereinafter collectively as the"Easement", are subject to
the following terms, conditions and restrictions:
A. The underground sewer line shall be,cased for a distance of approximately one hundred
ei�htv(180�feet as shown on Exhibit B attached hereto and incorporated herein by reference. Once the
casing is installed,the ground surface above the cased sewer line shall not be disturbed by Grantee except
as necessary to repair or replace the casing. Grantor shall have the unrestricted right to build permanent
structures over the cased area.
B. The Easement shall be restricted to the use of underground sewer lines and underground
tank,pump and appurtenances only unless Grantor shall consent in writing to other utility uses.
C. The additional five-foot(5')maintenance and access easement described in E�ibit A
shall be used only as reasonably necessary for maintenance of the underground sewer lines,tank,pump
and appurtenances. Any ground disturbed by such use shall be restored as nearly as possible to its natural
state.
D. Grantee shall have the reasonable right of ingress and egress over Grantor's property to
service and maintain said underground sewer lines,pump,tank and appurtenances.

E. Grantee agrees to hold Grantor harmless from any and all damage to persons or property
arising from the use of the Easement granted herein and agrees to pay any damages which may arise from
such use.
F. In the event of future building sites being located at or in proximity to the Easement,
Grantee at Grantee's expense,on written request of Grantor,agrees to either(1)reasonably relocate the
underground sewer lines in an easement area granted by Grantor, or(2)to encase the sewer lines so as to
prevent interference with such future building sites. The parties estimate that any relocation or
encasement for each building site is approximately one hundred(100)feet.
G. In the construction, laying and maintenance of the sewer lines, every reasonable good
faith effort shall be made to protect trees and vegetation;including hand digging and special treatment,
where necessary,to protect roots.
H. The Easement shall not be used for vehicular or foot traffic other than for maintenance
and repair purposes once construction of the initial lines is completed. Locked gates shall be installed and
maintained at each end of the Easement.
I. The construction and,thereafter,maintenance of the sewer lines shall be governed and
conditioned by, substantially,the same conditions and requirements as are attached to Grantee's Special
Use Permit No. 700519062378,dated June 23, 1978,for use of adjacent U. S.Forest Service lands,which
permit is on file at Grantee's principal place of business and incorporated herein by reference as though
set out in full.
J. The Easement shall inure to the benefit and burden of the heirs,executors,administrators,
assigns,grantees and successors of the respective parties hereto.
K. In the event Grantee abandons the sewer project for which the Easement is granted, or in
the event the project is built and later abandoned,then,in either event,this Grant of Easement shall
terminate.
L. Domestic water lines in the easement area shall be encased at the expense of Grantee in
the manner provided by the Uniform Plumbing Code.
IN WITNESS WHEREOF,this Grant of Easement has been executed by Grantor as of the
Effective Date.

This Certificate of Acceptance certifies that the interest in real property conveyed by
the above Grant of Easement dated February 1, 2013, between the South Tahoe Public
Utility District, a California Public Agency formed in 1950 pursuant to the Public Utility
District Act, and Ynez Taggart Kates, James M.Taggart and Beatrice M. Taggart,
individually and as Trustee of the Beatrice Taggart Trust, dated May 27, 1999, is hereby
accepted on behalf of South Tahoe Public Utility District pursuant to authority conferred
by resolution of the Board of Directors of the South Tahoe Public Utility District, adopted
