Subject: Recommendation for Bid Award for the Keller-Heavenly Water System
Improvements Project, Phase 1 - Rebid
Staff has reviewed the three bids received on April 6, 2021 for the rebid of the Keller-
Heavenly Water System Improvements Project, Phase 1 and recommends that the
Board, waive the minor irregularities in the bid from White Rock Construction (White
Rock), find that White Rock is the lowest responsible and responsive bidder and award
the contract for rebid of the Keller-Heavenly Water System Improvements Project,
Phase 1, to White Rock in the amount of $ 1,828,775.00.
As indicated in the summary prepared by the Contracts Administrator (attached), the
apparent low bid received from White Rock for the Project includes four minor
deviations. After careful consideration, Staff finds that White Rock’s bid documentation
is complete and that White Rock complied requirements of the bid documents. The
minor deviations do not impact the bid price and have not provided White Rock with a
material or competitive advantage over other Bidders, thus they may be waived by the
Board as immaterial minor deviations.
During the bid protest period, no bid protests were received nor did the District receive
any questions regarding the bids received.
In reviewing the bid pricing, Staff found the bids to be competitive and consistent with
recent bids received by the District.
In addition to the standard contractual items, the Drinking Water State Revolving Fund
(DWSRF) loan funding this project requires that White Rock comply with certain other
requirements, including:
a) Completion and submittal with the Bid of certain grant forms; and
b) Outreach to Disadvantaged Business Enterprises (DBEs).

Staff has performed a review of the Bid from White Rock with respect to these items.
All required forms were completed and submitted as required. In the review of White
Rock’s “good-faith effort,” Staff identified a single irregularity: Creekside Electrical
Contractors, Inc. was included as a DBE subcontractor, but did not have an active
listing on the Caltrans or Nevada DOT DBE databases. A current DBE certification is
required within 10 days of bid opening. In response to the District’s inquiry, Creekside
Electrical provided a copy of their DBE certification and renewed their listing with the
Nevada DOT. Staff confirmed that Creekside Electrical Contractor had an active DBE
listing and certification as of April 13, 2021.
Staff recommends that the Board, waive the minor irregularities in the bid from White
Rock Construction (White Rock), find that White Rock is the lowest responsible and
responsive bidder and award the contract for rebid of the Keller-Heavenly Water System
Improvements Project, Phase 1, to White Rock in the amount of $ 1,828,775.00.
