3 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SOUTH
TAHOE PUBLIC UTILITY DISTRICT TO FILE AN APPLICATION WITH THE
4 DEPARTMENT OF WATER RESOURCES TO OBTAIN A GRANT UNDER THE 2021
5 SUSTAINABLE GROUNDWATER MANAGEMENT ACT GRANT PROGRAM

WHEREAS, the Tahoe Valley South Subbasin was designated by the
7
Department of Water Resources ("DWR") as basin number 6-005.01 ("TVS
8
Subbasin");
9
WHEREAS, the South Tahoe Public Utility District ("District") boundary
10
overlies the majority of the TVS Subbasin;
11
WHEREAS, the El Dorado County Water Agency ("EDCWA")
12
boundary overlies the entire TVS Subbasin;
13
WHEREAS, for many years, the District and the EDCWA have worked
14
collaboratively to sustainably manage the TVS Subbasin in multiple ways
15
by sharing information, and jointly funding and implementing multiple
16
studies and monitoring program activities pursuant to an Amended and
17
Restated Memorandum of Understanding ("MOU");
18
WHEREAS, on July 16, 2015, the District adopted Resolution No.
19
2986-15 electing to be the Groundwater Sustainability Agency ("GSA") for
20
the portion of the TVS Subbasin within its service area boundary, submitted
21
its GSA Formation Notification to DWR on August 12, 2015, and was
22
recognized by DWR as the exclusive GSA for this portion of the TVS
23
Subbasin on November 17, 2015;
24
WHEREAS, on June 14, 2017, EDCWA adopted Resolution No. WA-
25
11-2017 electing to be the GSA for the portion of the TVS Subbasin outside
26
of the District's service area boundary, submitted its GSA Formation
27
Notification to the DWR on June 15, 2017, and was recognized by DWR as
28
the exclusive GSA for this portion of the TVS Subbasin on September 13,
29
2017;

1 WHEREAS, on July 17, 2019, DWR determined that the District's 2014
2 Groundwater Management Plan satisfied the objectives of SGMA and
3 approved it as an existing plan alternative to a Groundwater Sustainability
4 Plan ("Alternative Plan");
5 WHEREAS, the District and the EDCWA desire to continue to
6 cooperatively and sustainably manage groundwater resources within the
7 TVS Subbasin and to coordinate implementation of the Alternative Plan in
8 accordance with the MOU and SGMA; and,
9 WHEREAS, the Department of Water Resources is offering grants
10 under the 2021 Sustainable Groundwater Management Grant Program
11 pursuant to the California Drought, Water, Parks, Climate, Coastal
12 Protection, and Outdoor Access For All Act of 2018 (Pub. Resources Code,
13 § 80000, et seq.) and the Budget Acts of 2021 and 2022.
14 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
15 1. That an application be made by the South Tahoe Public
16 Utility District ("District") to the Department of Water Resources to obtain a
17 grant under the 2021 Sustainable Groundwater Management Grant
18 Program SGMA Implementation Grant pursuant to the California Drought,
19 Water, Parks, Climate, Coastal Protection, and Outdoor Access For All Act
20 of 2018 (Pub. Resources Code, § 80000, et seq.) and the Budget Acts of
21 2021 and 2022.
22 2. That the District has the authority and shall enter into a
23 funding agreement with the Department of Water Resources to receive a
24 grant for a project consisting of the following seven components:
25 a. Shallow Groundwater Monitoring - Groundwater
26 Dependent Ecosystems;
27 b. Surface Water Quality Monitoring;
28 c. Investigation and Removal of PCE Contaminated Soil
29 from the Tucker Avenue Stormwater Retention Basin;
30 d. TVS Subbasin Sentinel Well Monitoring;

1 e. LBWC #5 -Wellhead Treatment for
2 Tetrachloroethylene Removal from Groundwater-spent media change
3 out;
4 f. Public Outreach and Engagement; and,
5 g. Grant Administration.
6 3. No Bergsohn of the District, as the Alternative Plan Manager,
7 or his designee, is hereby authorized and directed to prepare the
8 necessary data, conduct investigations, file such application, execute a
9 funding agreement and any future amendments thereto, submit invoices,
10 and submit any reporting requirements with the Department of Water
11 Resources.
12 4. The Alternative Plan Manager, or his designee, is directed to
13 take all actions necessary and authorized to obtain the above-described
14 grant from the Department of Water Resources; and,
15 5. This Resolution shall take effect immediately.
16 WE, THE UNDERSIGNED, do hereby certify that the above and
17 foregoing Resolution was duly and regularly adopted and passed by the
18 Board of Directors of the South Tahoe Public Utility District at a meeting duly
19 held on the 17th day of November, 2022, by the following vote:
