ORDINANCE N0o~ I~ 2 2 ~ AN ORDINANCE DESCRIBING TERRITORY PROPOSED TO BE ANNEXED, DETERMINING THAT ~ TERMS AND CONDITIONS ARE NECESSARY~ AND DECLARING INTENTION TO APPROVE SUCH ANNEXATION ANNEXATION NO. 1965-4 BE IT ENACTED BY THE BOARD OF DIRECTORS OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT~ E1 Dorado County~ California~ as follows~ WHEREAS~ a petition signed by a majority of the qualified electors in certain unincorporated territory contiguous to the South Tahoe Public Utility District~ and being in the same County as said District~ asking that said territory be annexed to said District and consenting to suc~ annexation without an election~ was addressed to the Board of Directors and filed with the Secretary of the District on the 20th day of May~1965~ in accordance with the provisions of the Public Utility District Act of the State of California; WHEREAS, the said Secretary has caused to be compared the signatures on said petition with the affidavit of registration on file with the -County Clerk of the County of E1 Dorado~ and has found and certified to ~his Board that said petition has been signed by the required number of electors in said territory~ and has attached his signature to the said petition and presented said petition to this Board; NOW~ THEREFORE~ IT IS ORDERED~ as follows: Section 1. It is hereby determined that the annexation of said territory will facilitate the acquisition~ construction~ completion and operation of the public utility and public utility works of the District~ and will be for the advantage of said District and that the territory pro- posed to be annexed will be benefited by said proposed annexation. Section 2. It is hereby determined that the following terms and conditions for such annexation are necessary. a) That no sewer service will be provided to any of the territory proposed to be annexed until the District has reviewed~ sized~ and approved all trunk sewers~ pump stations and force mains to be installed in such territory° b) Annexation fees in effect at the time of the enactment of this ordinance shall be paid to District for those areas to be served by the District prior to the time that connection to District's system is made. Section 3. The exterior boundaries of said territory to be annexed are described in Exhibit "A" hereto attached and made a part hereof by reference° Section 4o It is hereby declared to be the intention of this Board to approve said annexation. The time -fixed for such hearing is not less than thirty nor more than sixty days from the date of the publication of this ordinance. Section 6. This ordinance~ together with a notice~ in form a copy of which is hereto attached and made a part hereof by reference~ shall be published pursuant to Section 6061 of the Government Code of the State of California~ to-wit: Once in the Tahoe Daily Tribune, a newspaper of general circulation printed and published in the District~ and shall be posted in three public places in the territory proposed to be annexed at least thirty days before the date set for said hearing.
