AN ORDINANCE OF THE SOUTH TAHOE PUBLIC
UTILITY DISTRICT RE RULES AND REGULATIONS
PERTAINING TO ACCEPTING A RIGHT TO CONNECT
DEPOSIT FOR SEWER CONNECTION FEES ........ 1981 ALLOCATION PROGRA~
BE IT ENACTED by the Board of Directors of the South
Tahoe Public Utility District, E1 Dorado County, California,
as follows:
(1) Ail residential owners selected in the 1981 Alloca-
tion Program will have thirty (30) days from notification by the
City of South Lake Tahoe to make a minimum deposit in the amount
equal to the established minimum sewer connection charges for the
designated sewer permit.
(2) Ail commercial owners or governmental agencies assign-
ed sewer units for a given project from the 1981 Allocation Program
must deposit connection fees within thirty (30) days from day of
assignment by City and/or County.
(3) Those applicants failing to make the minimum deposit
within the given time will lose the right to a sewer permit.
(4) In the event a sewer/building permit is not issued
or cancelled, no refund will be made until all property owners
selected have made their deposits and sewer units from cancelled
permit have been reassigned to another property, and that owner
has made a connection fee deposit.
(5) When any person by reason of special circumstances
is of the opinion that any provision of this ordinance is unjust
or inequitable as applied to his premises, he may make written
application to the Board, stating the special circumstances,
citing the provision complained of, and requesting suspension
or modification of that provision as applied to his premises.
If such application be approved, the Board may, by resolu-
tion, suspend or modify the provision complained of, as applied
to such premises, to be effective as of the date of the applica-
tion and continuing during the period of the special circumstances.
(6) Applicants who do not obtain a sewer permit during
the same calendar year that the minimum sewer deposit is made
shall be required to pay at the time of issuance of a sewer
permit any difference between the then existing sewer connection
charges and the minimum deposit made by the applicant.
This Ordinance shall take effect upon the expiration of
thirty (30) days after its passage and shall be posted by
the Clerk of the South Tahoe Public Utility District at three
(3) public places in said District at least one (1) week
before the expiration of said period after its passage and
shall further be published in the Tahoe Daily Tribune, a
newspaper of general circulation one (1) time only, at
