Ordinance No. 312 - SupersededORDINANCE NO. 3 1 2 AN ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT AMENDING ORDINANCE NO. 250, ESTABLISHING RULES FOR WATER SERVICE REQUIRING INSTALLATION OF SERVICE CONNEC- TION AND/OR METERING DEVICE, AND NEW CONNECTIONS, DISCONTINUANCE OF SERVICE AND RECONNECTIONS. BE IT ENACTED by the BOARD OF DIRECTORS of the SOUTH TAHOE PUBLIC UTILITY DISTRICT, County of E1 Dorado, State of California, as follows: THAT, SECTION 3.1 be amended as follows, and SECTIONS 8.3, 10.3 and 10.4: SECTION 3 WATER SERVICE REQUIRING INSTALLATION OF SERVICE CONNECTION AND/OR METER- ING DEVICE 3.1 Any person requesting water service requiring the installation of a service connection, and/or metering device (when so designated by the District) shall first make application therefore. No such device shall be rendered unless an application therefore is on file with the District, and permission to install such facilities has been given. If there is sufficient water and capacity available in the system to meet the requested service and applicant has complied with all requirements and is not delinquent in any amounts owed the District, the District shall furnish the water service requested upon payment of the applicable connection charge set forth below. This connection charge shall be collected when a sewer permit is issued. The District shall make the following charge for the installation of the service connection and metering device, which said service connection and metering devices shall remain the property of the District. SECTION 8.3 NEW CONNECTIONS - One-half of the annual flat rate, or minimum charge, shall be paid upon applica- tion for service. The amount paid in excess of the pro-rated bill for the initial period will be credit- ed against the charge for the succeeding period. New connections shall be billed from the first of the month following the month in which the sewer connection was inspected and approved. -1- ~ORDINANCE NO. 312 Page -2- SECTION 10.3 DISCONTINUANCE OF SERVICE - Service may be discontinued for any one of the following conditions: (1) (2) (3) (4) (5) Delinquency in the payment of any bill. Failure of the customer to maintain his facilitites in a suitable condition to prevent waste of water. The maintenance of any unprotected cross connections on the customer's premises or the lack of adequate back-flow protection at the service connection. Any violation of the provisions of this ORDINANCE by the customer or of any rules and regulations of the agency governing water service. Customer may request permanent discontinuance of service. SECTION 10.4 RECONNECTION - If water service is turned off for failure to pay any bill or for any violation of this ORDINANCE or any rules or regulations, the service shall not again be turned on until the amount due is paid in full, plus a charge for the restoration of service and the customer has deposited the amount required for new customers as provided in this ordinance. If water service was disconnected by owners request, service will not be restored until the connection fee in effect at the time has been paid, and there is sufficient water and capacity available in the system to meet the requested service. This ORDINANCE Amends ORDINANCE NO. 250 as stated above, passed and adopted at a regular meeting of the Board of Directors of the SOUTH TAHOE PUBLIC UTILITY DISTRICT, on the 15th day of MAY 1980. In all other respects, said ORDINANCE NO. 250, and ORDINANCES 257, 261, 269, 276, 292 amending No. 250, shall remain hereby ratified, confirmed and in full force and effect. This ORDINANCE shall take effect thirty (30) days after its passage. At least one (1) week before the expiration of said thirty (30) days period, copies of said ORDINANCE shall be posted by the Clerk of the South Tahoe Public Utility District at three (3) public places in said District, and at least one (1) week before the expiration of said thirty (30) day period, this ORDINANCE shall be published in the Tahoe Daily Tribune, a newspaper of general cir- culation, printed and published in said District one (1) time.
