AN ORDINANCE OF THE SOUTH TAHOE PUBLIC
UTILITY DISTRICT AWARDING CONTRACT FOR
THE LUTHER PASS EFFLUENT TRANSPORT
SYSTEM/REPLACEMENT AND SURGE PIPELINE
BE IT ENACTED by the Board of Directors of the South
Tahoe Public Utility District:
WHEREAS, pursuant to order of this Board of Directors
of the South Tahoe Public Utility District, County of E1 Dorado,
State of California, notice has been duly given for receiving of
bids for work on the South Tahoe Public Utility District Luther
Pass Effluent Transport System - Replacement and Surge Pipeline,
and said bids were publicly opened, examined and declared on
June 20, 1979, and have been duly considered by said Board:
NOW, THEREFORE, it is ORDERED by said Board of Directors
as follows:
1. Said Board hereby rejects all of said proposals or
bids, except that bid hereinafter mentioned, and hereby awards
the contract for doing the work and improvements and furnishing
of materials, supplies and equipment necessary for the construction
of LUTHER PASS EFFLUENT TRANSPORT SYSTEM, REPLACEMENT AND SURGE
PIPELINE IMPROVEMENTS to the lowest responsible bidder, to wit:
H.M. BYARS CONSTRUCTION, INC., 2255 Byars Road, Reno, Nevada, at
the lump sum price named in its bid to wit: $889,369.00 (Eight
Hundred Eighty-Nine Thousand, Three Hundred and Sixty-Nine Dollars,
AND,
2. The description of the contract work is as follows:
(a) High lift discharge replacement pipeline, complete,
except for sheeting, shoring, and bracing as required for all ex-
cavations five (5) feet or over in depth;
(b) Sheeting, shoring and bracing as required for all
excavations five (5) feet or over in depth;
(c) Surge Protection Pipeline, complete except for
sheeting, shoring and bracing as required for all excavations
five (5) feet or over in depth.
(d) Sheeting, shoring and bracing as required for all
excavations five (5) feet or over in depth.
(e) Sheeting, shoring and bracing are listed separately
from its associated work in accordance with the CALIFORNIA LABOR
CODE, SECTION 6707, and the work included shall be for whatever
measures that are to be used to perform the work in accordance
with the required trench and excavation safety plans.

The contract award is subject to the following
Drawing submittal information;
Participation in pre-construction conferences;
Submittal of required bonds and insurance certificates;
Approval by the State Water Resources Control Board
of plans and specifications, and
No field construction work shall take place unless
approved in writing by the South Tahoe Public Utility District.
5. The Board waives the informality in the H.M. BYARS
CONSTRUCTION COMPANY bid schedule wherein an incorrect number is
shown for the lump sum total while the correct words and total are
shown in the Proposal.
6. The President of the Board of Directors is hereby
authorized to make and enter into a written contract with said
successful bidder and to receive and approve all bonds in connection
therewith, and the Clerk is hereby directed to attest her signature
and affix thereto the corporate seal of said District, all in ac-
cordance with plans and specifications and special conditions and
notice to bidders thereto approved and placed on file with the
District, and
7. Upon adoption, this ORDINANCE shall be posted in three
(3) public places at least seven (7) days prior to the expiration
of thirty (30) days from the date of its passage, and shall be
published in the TAHOE DAILY TRIBUNE, a newspaper of general cir-
culation in the District one (1) time at least seven (7) days prior
to thirty (30) days from the date of its passage, and shall be
effective upon receipt of said written approval or upon expiration
of thirty (30) days after passage of this ORDINANCE, whichever occurs
later.
