ORDINANCE NO. 265
AN ORDINANCE CALLING A SPECIAL DISTRICT
ELECTION IN THE SOUTH TAHOE PUBLIC UTIL-
ITY DISTRICT FOR THE PURPOSE OF SUBMITTING
TO THE ELECTORS OF SAID DISTRICT A PROPO-
SITION CONCERNING WHETHER THE DISTRICT SHALL
ENTER INTO A CONTRACT WITH THE STATE WATER
RESOURCES CONTROL BOARD FOR A CONSTRUCTION
LOAN UNDER CHAPTER 6 OF DIVISION 7 OF THE
WATER CODE OF THE STATE OF CALIFORNIA; DE-
CLARING THE GENERAL PURPOSE OF THE CONTRACT
AND THE MAXIMUM AMOUNT OF MONEY TO BE BOR-
ROWED UNDER THE CONTRACT; FIXING THE DATE
OF SAID ELECTION; AND PROVIDING FOR NOTICE
OF SAID ELECTION
BE IT ENACTED by the Board of Directors of the South Tahoe
Public Utility District:
WHEREAS, the District, on February 3, 1977, did submit to
the State Water Resources Control Board an application under Chapter
6 (commencing with Section 13400) of Division 7 of the Water Code
of the State of California for a construction loan from the State
Water Quality Control Fund for a project referred to in said appli-
cation as the rehabilitation of the District pipeline used for ex-
port of reclaimed wastewater out of the Tahoe Drainage Basin, which
project is more particularly described in said application and which
application is on file in the office of the District Secretary; and
WHEREAS, under Section 13416 of the Water Code of the State of
California, before the District may enter into a contract with the
State Water Resources Control Board for a construction loan under
Chapter 6 of Division 7 of the California Water Code, the District
is required to hold an election on the proposition of whether or
not the District shall enter into the proposed contract;
NOW, THEREFORE, it is hereby ORDERED, as follows:
1. A Special District Election be, and it is hereby, pro-
claimed, called and ordered and will be held in the South Tahoe
Public Utility District on Tuesday, the 31st day of May, 1977, at
which election there shall be submitted to the qualified voters of
said District the question of whether the District shall enter into
a contract with the State Water Resources Control Board for the
object and purpose set forth in the.following proposition, to wit:
PROPOSITION: Shall the South Tahoe Public
Utility District enter into a
contract with the State Water Resources Control
Board for a construction loan in the maximum amount
of $ 1,700,000 for the general purpose of rehabili-
tation of the South Tahoe Public Utility District
pipeline used for export of reclaimed wastewater
out of the Tahoe Drainage Basin and all work and
incidental expenses necessary or convenient thereto?
2. The general purpose of the contract proposed to be entered
into with the State Water Resources Control Board is for a construc-
tion loan to the District from said Board for the rehabilitation of
the District pipeline used for export of reclaimed wastewater out of
the Tahoe Drainage Basin and the maximum amount of money to be bor-
rowed from the state under the contract is $1,700,000
3. The Board of Directors does hereby submit to the qualified
voters of said South Tahoe Public Utility District at said Special
District Election, this ordinance and the propo-sition set forth in
Section 1 hereof. The Board of Directors proposes to enter into the
aforesaid contract for the objects and purposes specified in said
proposition if more than 50 percent of the votes cast at such elec-
tion are in favor of said proposition and if more than 50 percent of
the votes cast at such election are in favor of said proposition,
said proposition shall be deemed adopted.
4. The said Special District Election shall be held and con-
ducted, the votes thereof canvassed, the returns thereof made, and
the result thereof ascertained and determined as herein provided,
and in all particulars not prescribed by this ordinance said elec-
tion shall be held as provided by law for the holding of general
district elections.
5. The descriptions and designations of the election pre-
cincts, polling places and the election officers to conduct said
election will be designated and established by the County Clerk
of E1 Dorado County at least 30 days prior to the day fixed for
the election pursuant to the provisions of Section 23528 of the
Elections Code of the State of California.

6. The County Clerk of E1 Dorado County shall canvass the
returns of the Special District Election and shall prepare and mail
a statement of results to the Clerk and Ex-Officio Secretary of the
South Tahoe Public Utility District pursuant to the provisions of
Sections 23550 through 23553, inclusive, of said Elections Code.
7.~ All persons qualified to vote at general district elec-
tions in said District upon the date of the election herein pro-
vided for shall be qualified to vote upon the proposition submitted
at said Special District Election.
8'. Ballots for said eleCtion shall be provided of the form
and to the number provided by law. On said ballots, in addition
to any other printed matter which may be required by law, two voting
squares shall be set off to the right of, or directly underneath, the
proposition submitted at the election, in the manner provided by iaw,
one having the words "Execution of contract--Yes" printed before it
and the other having the words "Execution of contract--No" printed
before it.
9. Each voter to vote for the proposition and for execution
of said contract shall stamp a cross (+) in the blank space opposite
the words "Execution of contract--Yes" on the ballot to the right
of, or directly underneath, the proposition, and to vote against
the proposition and against execution of said contract shall stamp
a cross(+) in the blank space opposite the words "Execution of
contract--No" on the ballot to the right of, or directly underneath,
the proposition, except that in the event that voting machines are
used, voters shall vote for or against said proposition and the
execution of the contract in accordance with standard procedures
for use of such voting machines.
10. The polls shall be opened at 7 o'clock a.m. of the day
of the election and shall be kept open until 8 o'clock p.m. of the
same day, when the polls shall be closed, except as to voters in
line as provided in Section 14436 of the Elections Code.
11. This ordinance shall take effect 30 days after its passage.

12. This ordinance shall be posted in three public places
pursuant to Section 16075 of the Public Utilities Code of the State
of California and shall be published once in the Tahoe Daily Tri-
bune, a newspaper of general circulation printed and published in
the District at least one week before the expiration of 30 days
after its passage.
13. Additionally, a Notice and Proclamation of Special Dis-
trict Election in the form attached hereto as Exhibit "A," shall be
published one time no later than March 17, 1977, in the Tahoe Daily
Tribune, a newspaper of general circulation within the South Tahoe
Public Utility District.

SOUTH TAHOE PUBLIC UTILITY DISTRICT
NOTICE AND PROCLAMATION ARE HEREBY GIVEN AND MADE by the
Board of Directors of the South Tahoe Public Utility District, E1
Dorado County, California, pursuant to the provisions of Sections
2554 and 2653 of the Elections Code of the State of California,
that a special district election is hereby called and will be held
on Tuesday, the 31st day of May, 1977, within the boundaries of the
South Tahoe Public Utility District, for the purpose of submitting
to the qualified electors of said District the following proposition:
PROPOSITION: Shall the South Tahoe Public
Utility District enter into a
contract with the State Water Resources Control Board
for a construction loan in the maximum amount of
