Ordinance No. 268WJML: RJH :pn 5/31/77 ORDINANCE NO. 268 AN ORDINANCE ESTABLISHING AND FIXING SPECIAL CONNECTION CHARGES FOR CONNECTIONS TO THE FALLEN LEAF LAKE TRUNK SEWER MAINS OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT Be it enacted by the Board of Directors of the South Tahoe Public Utility District, E1 Dorado County, California, as follows: 1. Purpose. To provide for payment, with respect to non- assessed properties, of the proportionate share of said properties of the costs of trunk sewer mains to be installed to serve the Fallen Leaf Lake area, thereby establishing conditions of equality between properties to be served by said mains. 2. Definitions. For purposes hereof: (a) "Trunk sewer mains" include and mean any sewer main which forms a part of the trunk sewer system within the boundaries of Assessment District 1971-1 of the South Tahoe Public Utility District and the installation of which is or will be financed, in whole or in part, by proceeds of assessments and/or bonds sold to represent unpaid assessments levied in the proceed- ings conducted for said assessment district, a description of which are contained in clause "a", at numbers (1) , (3) , (4), (5) , (6), (8) , (10) , (11) and (12) , of the Second Amended Exhibit A attached to and made a part of Resolution No. 2076 adopted by the Board of Directors of this Utility District on June 16, 1977. (b) "Non-assessed properties" include and mean proper- ties within the boundaries of said Assessment District 1971-1 which were and/or will not be assessed in the proceedings conducted for said assessment district, whether for the reason that such properties were and/or are owned by governmental agencies, or departments thereof, whose property is not subject to assessment by this Utility District or for other reasons. 3. Special Connection Charges - When Applicable. There shall be collected, prior to conn~cti~on to ~ho sanitary ~oworaqo system of this Utility District, a special connection charge for any non-assessed property that will be served by a connection from said property the sewage from which will be transported to this Utility District's treatment plant via any portion of the Fallen Leaf Lake trunk sewer mains; provided, only that said special connection charge shall not be applicable to any property for which a proportionate cost of said trunk sewer mains is or was paid by means of a special assessment. 4. ~pecial Connection Charge - Amount. Said special connection charge shall be collected, in addition to all other charges established by the ordinances, rules and regulations of this Utility District, in the amount of $3,792.42 per dwelling unit to be served by such connection. 5. Special Connection Charge-- Adjustment. The amount of said special connection charge is based on the estimated costs of installation of the Fallen Leaf Lake trunk sewer mains, namely, $951,979.32, with seventeen and thirteen one-hundredths percent (17.13%) of said costs being attributed to said non-assessed properties. Accordingly, in the event the actual costs of said trunk sewer mains are greater or lesser than said estimated costs, said special connection charge shall be proportionately reduced. 6. USe of Funds. Sums collected pursuant hereto shall.be credited to a special fund designated "Fallen Leaf Lake Trunk Sewer Mains." From time to time, as appropriate, moneys in said special fund shall be credited upon the special assessments levied in the proceedings conducted for said Assessment District 1971-1, which credits shall be made in the manner provided in Division 12 of the Streets and Highways Code, State of California, for credit upon special assessments of any excess realized from the assessments. 7.
