ORDINANCE NO. 3 3 9
AN ORDINANCE OF AWARD OF CONSTRUCTION CONTRACT
ASSESSMENT DISTRICT 1982-1
(SOUTH TAHOE "Y" WATER IMPROVEMENTS)
BE IT ENACTED, by the Board of Directors of the South Tahoe Public
Utility District, County of E1 Dorado, California, that
WHEREAS, on the 3rd day of ~ 1982, the Clerk and ex-officio
Secretary of the South Tahoe Public Utility District publicly opened, examined
and declared all sealed proposals or bids for the work to be done and
improvements to be made, as described and specified in Resolution of Intention
No. 2245, adopted by this Board on May 6, 1982, to which resolution and the
plans and specifications reference is hereby made for a description of said
work and improvements to be done and the materials, supplies and equipment to
be furnished therefor; and
WHEREAS, said bids were referred to and considered by this Board at its
meeting on J~¥ 29 , 1982;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. This Board hereby rejects all of said proposals or bids except that
hereinafter mentioned, and hereby awards the contract for doing said work and
improvements and furnishing the supplies, materials and equipment necessary
therefor, to the lowest responsible bidder, to wit:
SOUTH LAKE TAHOE, CALIFORNIA
at the unit prices specified in the bid of said low bidder.
2. The PRESIDENT of this District is hereby authorized to
make and enter into a written contract with said successful bidder, and to
receive and approve all bonds in connection therewith, and the Clerk and
ex-officio Secretary of this District is hereby directed to attest the
signature of said PRESIDENT and affix thereto the official seal of
this District.
3. The District Engineer shall, within five (5) days of the adoption
of this resolution, transmit an Extract of Public Works Contract Award to the
Department of Industrial Relations, Division of Apprenticeship Standards, P.O.
Box 603, San Francisco, California 94101. Should a finding of any discrepancy
regarding the ratio of apprentices to journeymen be .made, the Division of
Apprenticeship Standards shall be notified of such findings.

CONTRACT AGREEMENT
THIS AGREEMENT, made and entered into this 30thday
of July , 1982, by and between Thomas Haen, doing
business as Thomas Haen Company hereinafter called "Contractor",
and the South TaHoe Public Utility District, hereinafter called
"District".
WHEREAS, District has awarded to Contractor a contract
for performing the work hereinafter mentioned, in accordance with
the sealed proposal of said Contractor;
NOW, THEREFORE, IT IS AGREED, as follows:
1. Scope of Work. Contractor shall perform all the
work, and furnish all the labor, materials, equipment and all
utility and transportation services required to complete all of the
work and construction and installation of the improvements, the
items and quantities of which are more particularly set forth in
the Contractor's Bid therefor on file in the office of District,
exceDt work done or to be done by others, and attached hereto as part
of tSis agreement.
2. Time of Performance and Liquidated Damages.
Contractor shall begin work within ten (10) days after official
notice by District to proceed with the work and shall diligently
prosecute the same to completion before the expiration of
seventy-five (75) days, or before October 15, 1982, whichever comes
first, from the date of issuance of said notice.
District has determined, by Resolution No. 2247 duly
adopted on May 6, 1982, that in the event Contractor does not
complete the work within the time limit so specified or within such
further time as District shall have authorized, Contractor shall
pay to District liquidated damages in the amount of One Hundred
Dollars ($100.00) per calendar day for each and every day's delay
in finishing the work beyond the completion date so specified.
Additional provisions with regard to said time of completion and
liquidated damages are set forth in the specifications, which
provisions are hereby referred to and incorporated herein by
reference.
3. ~. Payments will be made by District to
Contractor for said work performed at the times and in the manner
provided in the specifications and at the unit prices stated in
Contractor's bid.
4. Component Parts. This contract shall consist of the
following documents, each of which is on file in the office of
District and all of which are incorporated herein and made a part
hereof by reference thereto:

c) Instruction and Information to Bidders
d) Accepted Proposal
e) Faithful Performance Bond
f) Labor and Material Bond
g) Special Provisions
h) Standard Specifications
i) Design Standards
j) Plans and Detailed Drawings
k) Resolution of Intention and Related Proceedings
5. ~_~. Pursuant to Section 1773 of the Labor
Code of the State of California, District has obtained from the
Director of the Department of Industrial Relations the general
prevailing rate of per diem wages and the general prevailing rate
for holidays and overtime work for each craft, classification, or
type of worker required to execute the contract. Copies of said
prevailing rate of per diem wages are on file in the principal
office of District, which shall be made available to any interested
party on request, and a copy thereof will be posted at the job
site. The provisions of Article 2, Chapter 1, Part 7, Division 2
(commencing with Section 1770) of the Labor Code, and particularly
Section 1775 thereof, shall be complied with.
6. Hours of Work. Contractor shall forfeit, as penalty
to District, Twenty-Five Dollars ($25.00) for each worker employed
in the execution of the contract by Contractor or by any
subcontractor, for each calendar day during which any worker is
required or permitted to work more than eight (8) hours in any one
calendar day and forty (40) hours in any one calendar week, in
violation of the provisions of Article 3, Chapter 1, Part 7,
Division 2 (commencing with Section 1810) of the Labor Code of the
State of California.
7. Apprentices. In accordance with the provisions of
Section 1777.5 of the Labor Code, and in accordance with the rules
and procedures of the California Apprenticeship Council, properly
registered apprentices shall be employed in the prosecution of the
work. The ratio of apprentices to journeymen who shall be employed
in the respective crafts or trades may be the ratio stipulated in
the apprenticeship standards under which the appropriate joint
apprenticeship committee operates. In no event shall the ratio be
less than one apprentice for each five journeymen unless a
certificate of exemption has been issued by the Division of
Apprenticeship Standards. Willful failure by Contractor to comply
with said Section 1777.5 shall result in its being denied the right
to bid on any public works contract for a period of one year from
the date the determination of noncompliance is made and its
forfeiting as a civil penalty the sum of Fifty Dollars ($50.00) for
each calendar day of noncompliance.
Information relative to number of apprentices,
identifications, wages, hours of employment and standards of
working conditions shall be obtained from the Administrator of
Apprenticeship. The responsibility of compliance with said Section
1777.5 shall be with the prime contractor.
8. Labor Discrimination- Attention is directed to
Section 1735 of the Labor Code, which reads as follows:
"No discrimination shall be made in the
employment of persons upon public works
because of the race, religious creed, color,
national origin, ancestry, physical handicap,
medical condition, marital status or sex of
such persons, except as provided in Section
12940 (of the Government Code), and every
contractor for public works violating this
section is subject to all the penalties
imposed for a violation of this chapter."
9. Worker's Compensation Insurance. In accordance with
the provisions of Article 5, Chapter 1, Part 7, Division 2
(commencing with Section 1860) and Chapter 4, Part 1, Division 4
(commencing with Section 3700) of the Labor Code of the State of
California, Contractor is required to secure the payment, of
compensation to his employees and shall for that purpose obtain
and keep in effect adequate Worker's Compensation Insurance.
Contractor is aware of the provisions of Section 3700 of
the Labor Code, which requires every employer to be insured
against liability for worker's compensation or to undertake
self-insurance in accordance with the provisions of that Code, and
will comply with such provisions before commencing the performance
of the work on this contract.
10. Substitution of Securities. Pursuant to Section
4590 of the California Govenment Code, Contractor is permitted to
substitute securities for any moneys withheld by District to
ensure performance under a contract. At the request and expense
of Contractor, securities equivalent to the amount withheld shall
be deposited with District, or with a state or federally chartered
bank as the escrow agent, who shall pay such moneys to Contractor
upon satisfactory completion of the contract. Securites eligible
for investment shall include those listed in Section 16430 of the
California Government Code, or bank or savings and loan
certificates of deposit. Contractor shall be the beneficial owner
of any securities substituted for moneys withheld and shall
receive any interest thereon.

THE UNDERSIGNED BIDDER, having examined the Bidding Requirements, Contract Forms,
General Conditions, specifications, and other proposed contract documents, and
all addenda thereto; and being acquainted with and fully understanding (a) the
extent and character of the work covered by this Bid Form; (b) the location,
arrangement, and specified requirements of the proposed work; (c) the location,
character, and condition of existing streets, roads, highways, pavements,
surfacings, walks, driveways, curbs , gutters, trees, sewers, utilities, drainage
courses and structures, and other installations, both surface and underground,
which may affect or be affected by the proposed work; (d) the condition and
nature of existing structures and facilities affected by the work; (e) local
conditions relative to labor, transportation, hauling, and delivery facilities;
and (f) all other factors and conditions affecting or which may be affected by
~he work,
~'HEREBY PROPOSES to furnish all materials, equipment, supplies, and appurtenances;
to provide all construction plant, equipment, and tools, to perform all necessary
labor and supervision; and to construct, install, erect, equip, and complete all
work stipulated in, required by, and in accordance with the proposed contract
documents and the specifications,' and other documents referred to therein (as
altered, amended, or modified by addenda), and to do all the work and furnish
all the material specified in the contract and annexed plans and specifications.
It being Understood and agreed that the quantities shov~ herein are approximate
only and are subject to increase or decrease, and that he will accept in full
payment therefor, the unit prices shown in Bid Schedules A, B, C, and D.
The bidder shall be required to bid all items of Schedules A, B, C. and D.
The South Tahoe Public Utility District will make the final decision and selection
between the two types of pipe material prior to selecting the successful bidder.
Pipe Material No. 1 - PVC Water Pipe
Pipe Material No. 2 - Glass-fiber-Re-inforced Thermosetting-
Resin Water Pipe
(Bids shall include all sales tax and all other applicable taxes and fees).
Ail work under Bid Schedule "A" will be paid for from a separate special fund
administered by S.T.P.U.D. Monies received from property owners on or from the
ale of bonds for Assessment District 1982-1 will be deposited in this special fund.
,~11 items under Bid Schedule "B", "C", and "D" will be paid for from S.T.P.U.D. funds.
The undersigned bidder agrees to furnish the required bonds and to enter
into a contract within ten (10) days after acceptance of this bid, and further
agrees to complete all work in accordance with specified requirements by
October 15, 1982, or within 75 days whichever comes first. Enclosed with this
bid is a hid deposit in the form of a certified cashiers check for

Public Utility District as liquidated damages in the event this bid is accepted

In submitting this bid it is understood that the right is reserved by the
Owner to reject any and all bids, and it is understood that this bid may not be
withdrawn during a period of s~xty (60) days after the schedule time for the
receipt of bids.
The undersigned bidder hereby certifies (a) that this bid is genuine and
is not made in the interest of, or in the behalf of any undisclosed person,
firm, or corporation, and is not submitted in conformity with any agreement of
rules of any group, association, organization, or corporation; (b) that he has
