AN ORDINANCE OF SOUTH TAHOE PUBLIC UTILITY
DISTRICT PROVIDING FOR PAYI~;ENT OF PENALTIES,
INTEREST AND ADDITIONAL COLLECTION COSTS FOR
DELINQUENT SEWER SERVICE AND STREET LIGHTING CHARGES
BE IT ENACTED by the Board of Directors of the South
Tahoe Public Utility District, E1 Dorado County, California, as
follows:
1. After hearing, the Board of Directors finds:
A. Sewer Service and Street Lighting Charges shall
become delinquent sixty (60) days after billing date.
B. The estimated reasonable cost to District for
delinquent Sewer Service and Street Lighting Charges from the
date of delinquency is 10% of said charges.
C. The estimated reasonable cost to District of
Sewer Service and Street Lighting Charges delinquencies not paid
by the next billing date following that billing date for which
said charges are due is the legal interest rate of 10% per annum
from the billing date for which charges are due.
D. The estimated reasonable cost to District of
legal enforcement collection of Sewer Service and Street Lighting
Charges is the actual administrative, attorney, and legal costs
for said collection.
2. Sewer Service and Street Lighting Charges are de-
linquent sixty (60) days after the biling date therefor.
3. A penalty of 10% is assessed for delinquent Sewer
and Street Lighting Charges.
4. Sewer Service and Street Lighting Charges delinquent
at the next billing date following the billing date for which
said Sewer Service and Street Lighting Charges are due shall
be assessed interest at the legal rate of 10% from the billing
date for which said charges are due.
5. The actual administrative, attorney, and legal costs
for legal enforcement collection of Sewer Service and Street
Lighting Charges shall be added to any penalty and any interest
due for delinquent Sewer Service and Street Lighting Charges.
6. This Ordinance is limited to delinquent penalties,
interest, and collection costs for Sewer Service and Street
Lighting Charges. It is not intended to amend any provision
of any other applicable Ordinance regarding Sewer Service and
Street Lighting Charges.
7. If any section, sub-section, sentence, clause or
phrase of this Ordinance, or the application thereof to any person
or circumstance is for any reason held to be unconstitutional
or invalid, such decision shall not affect the validity of the
remaining portions of this Ordinance or the application of such
provision to other persons or circumstances. The Board hereby
declares that it would have passed this Ordinance or any section,
sub-section, sentence, clause or phrase hereof irrespective of
the fact that any one or more sections, sub-sections, sentences,
clauses or phrases be declared to be unconstitutional or invalid.
3. This Ordinance shall take effect upon the expiration
of thirty (30) days after its passage and shall be posted by the
Clerk of the South Tahoe Public Utility District at three (3)
public places in said District at least one (1) week before the
expiration of said period after its passage and shall further be
published in the Tahoe Daily Tribune, a newspaper of general
circulation, one (1) time only, at least one (1) week before
the expiration of said period.

In case there is any question, the first Ordin-
ance No. 350 mailed to you on June 20, 1983 did not
include Street Lighting Charges and is not the Ordinance
which was published and posted.
Ordinance No. 350, which should be signed and
placed in the District files, is the one which includes
Street Lighting Charges mailed to you on June 23, 1983.
Ordinance No. 351 regarding Water Service Charges
is correct.
There should be an affidavit of publication for
Wednesday, June 22, 1983, and Bob Eppler posted the
Ordinances on June 22, 1983. You will need to get a Cer-
tificate of Posting for the District files.
