6 The Board of Directors of the~District finds:
7 1. Pursuant to order of this Board of Directors of the
8 South Tahoe Public Utility District, County of E1 Dorado,
9 State of California, notice was duly given for receiving bids for
10 Ski Run Water Improvements, Contract No. 2, Bid No. 84-85-12,
]] South Tailoe Public Utility District, and eight (8) bids were
12 received at the time and place specified, at 2:00 P.M. on Tuesday
13 December 18, 1984, and publicly opened.
14 2. Thomas Haen Company, Inc. bid the apparent low bid in
]5 the amount of $168,978.00 for Item No. 1 through Item No. ll.
16 3. Pursuant to Chapter 5, Relief of Bidders, Public
17 Centract Code Section 5100, et seq.~said Thomas Haen Company, Inc
]8 claimed relief of its bid, which relief of bid was granted by
19 motion of the Board of Directors of South Tahoe Public Utility
20 District on December 20, 1984.
2] 4. The apparent second low bid of Wunschel & Small, Inc.
22 in the amount of $337,150.00 for the total of Item No. 1 through
23 Item No. ll thus became the apparent low bid.
24 5. Wunschel & Small, Inc. failed to include in its bid,
25 the following:
26 "Part 15 - Lost Time Accident
27 15.01 Each Bidder shall submit with his bid:
28 A. Record for the past 3 years of lost time accidents

on previous projects for the Owner's information.
B. A copy of the company safety program
6. South Tahoe Public Utility District had on record,
at the time of the submission of the Wunschel & Small, Inc.
bid for the above contract,'the record for the past 3 years of
lost time accidents on previous projects of said Wunschel &
Small, Inc., and a copy of the company~safety program of said
Wunschel & Small, Inc.
7. The bid requirement of submission of record of lost
time accidents on previous projects and a copy of the company's
safety program was for the District's information.
8. Under said circumstances, the failure of Wunschel &
Small, Inc. to submit with its bid said record of lost time
accidents on previous projects and said copy of the company
safety program is an irregularity which can be waived in the
discretion of the Board of Directors of South Tahoe Public
Utility District.
9. It is in the best interest of the Board of Directors
of South Tahoe Public Utility District to waive said irregularity
10. Under the circumstances, the lowest, responsive,
responsible bid for the Ski Run Water Improvements, Contract No.2
is Wunschel & Small, Inc.
NOW, THEREFORE, BE IT ENACTED by the Board of Directors
of the South Tahoe Public Utility District, County of E1 Dorado,
State of California, as follows:
1. Said Board of Directors does hereby waive the
irregularity in the bid of Wunschel & Small, Inc. of failure to
submit with its bid a record for the past . 3 years of lost time

3 of the South Tahoe Public Utility District at the time of the
4 making of the Wunschel & Small, Inc. bid, and said requirement
5 was for the information only of South Tahoe Public Utility Dis-

7 2. Said Board of Directors does hereby determine that
8 the bid of Wunschel & Small, Inc., P.O. Box 799, Fair Oaks, CA,
9 95628, is the lowest, responsive, responsible bidder for doing
l0 the work and improvements and furnishing the labor, materials,
Il supplies, and equipment necessary for the ski Run Water
~2 Improvements, Contract No. 2, Bid No. 84-85-12, South Tahoe
13 Public Utility District.
14 3. Said Board of Directors does hereby award said con-
~5 tract for doing the work and improvements and furnishing the
16 labor, materials, supplies, and equipment necessary for the Ski
~7 Run Water Improvements, Contract No. 2, Bid No. 84-85-12, South
18 Tahoe Public Utility District, at the price named in its bid for
19 Bid Items No. 1 through No. ll of Three Hundred Thirty-Seven
20 Thousand, One Hundred Fifty Dollars ($337,150.00).
2! 3. The President of said Board of Directors is hereby
22 authorized to make and enter into a written contract with said
23 successful bidder, Wunschel & Small, Inc., and to receive and
24 approve all bonds in connection therewith, and the Clerk is
25 hereby directed to attest to said President's signature and affix
26 thereto the corporate seal of said District, all in accordance
27 with the plans and specifications, special conditions and notice
28 to bidders thereto approved and on file with the District.

4. Upon adoption, this Ordinance shall be posted in
three (3) public places at least seven (7) days prior to the
expiration of thirty (30) days from the date of its passage, and
shall be published in the Tahoe Daily Tribune, a newspaper of
general circulation published in the District, one (1) time at
least seven (7) days prior to thirty (30) days from the date of
its adoption.
PASSED AND ADOPTED by the Board of Directors of the
South Tahoe Public Utility District at its duly held adjourned
regular meeting on the 3rd day of January, 1985, by the following
