2 AN ORDINANCE OF SOUTH TAHOE PUBLIC UTILITY DISTRICT
3 PROVIDING FOR DETERMINATION OF THE LOWEST RESPONSIBLE BIDDER
4 The Board of Directors of SOUTH TAHOE PUBLIC UTILITY
5 DISTRICT finds:
6 Where items contracted for by bid cons~ts of equipment and/
7 or vehicles that may require maintenance service after delivery
8 to the DISTRICT, the additional cost to the DISTRICT for main-
9 tenance service accessibility for such equipment and/or vehicles
l0 is at least three percent (3%) of the bid, if the bidder does nol
I! have a fixed place of business within the DISTRICT boundaries for
12 maintenance service for such equipment and/or vehicles.
13 THEREFORE, BE IT ENACTED by the Board of Directors of
14 SOUTtt TAHOE PUBLIC UTILITY DISTRICT as follows:
15 1. The award of a contract to furnish equipment and/or
16 vehicles to the SOUTH TAHOE PUBLIC UTILITY DISTRICT shall be
17 awarded to the lowest responsible bid.
18 2. Where the equipment and/or vehicles contracted for may
19 require maintenance service after delivery to the DISTRICT, thre~
20 (3%) of the bid shall be deducted from the bid of those bidders
2~ having a fixed place of business within the DISTRICT boundaries
22 for maintenance service for those items of equipment and/or
23 vehicles bid, solely and only for the purpose of determining the
24 lowest responsible bidder, in recognition of greater maintenance
25 service accessibility to the DISTRICT.
26 Following three percent (3%) deduction, if the bidder is
27 determined to be the lowest responsible bidder, the bid shall
28 then be awarded at his bid price without such deduction.

4. This Ordinance supersedes any Ordinance, Resolution,
Rule or Regulation heretofore adopted by the DISTRICT in de-
termining the lowest responsible bidder for equipment and/or
vehicles.
5. This Ordinance shall take effect upon the expiration
of thirty (30) days afer its passage and shall be posted by the
Clerk of the SOUTH TAHOE PUBLIC UTILITY DISTRICT at three (3)
public places in said District at least one (1) week before the
expiration of said period after its passage and shall further be
published in the Tahoe Daily Tribune, a newspaper of general
circulation, one (1) time only, at least one (1) week before the
expiration of said period.
Passed and adopted this 19th day of December, 1985 at a
duly held regular meeting of the Board of Directors of SOUTI.!
