Ordinance No. 392ORDINANCE NO. 392 AN ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT AMENDING ARTICLE X, SECTION 10.10 ONLY OF ORDINANCE NO. 372 AND PROVIDING FOR SERVICE CHARGES AND CONNECTION CHARGES FOR UNREPORTED CONNECTIONS AND DISCHARGES f~_~3 BE IT ENACTED by the Board of Directors of the SOUTH TAHOE PUBLIC UTILITY DISTRICT, E1 Dorado County, California, as follows: 1. Article X ,Section 10.10 of said Ordinance No.372 shall be amended in its entirety as follows: ARTICLE X COLLECTION AND ENFORCEMENT Section 10.10 Unreported Connections and discharges. Upon discovery of unreported connections and discharges to the public sewer system, the District shall charge all current charges and fees, including all current connection charges, plus ten (10%) percent basic penalty, up to three (3) years back charge for current sewer service fees, ten (10%) percent penalty, and three hundred dollars ($300.00) administrative fees. The owner of said property may, at his option, abate the unreported connection(s) immediately or pay all the above charges and fees. If the owner elects to abate the unreported connection(s) the District shall then charge up to three (3) years back charge for current sewer service fees, ten (10%) percent penalty, and three hundred dollars ($300.00) administrative fees. If the owner fails to do either of the above options, all charges and fees shall be deemed charges for the purposes of collection and enforcement, and the ORDINANCE NO. 392 Page Two property shall be subject to disconnection procedures for delinquent charges as set forth in Section 10.8 of Ordinance No. 372, which said Section 10.8 is incorporated herein by reference. 2. The Board of Directors finds that the estimated cost of discovering unreported connections, collecting and administering such unreported connections and loss of use of funds approximate the penalties and administrative fees in this Section 10.10 provided. 3. Ratification of Former Ordinance. Except as Article X, Section 10.10 of Ordinance No. 372 is amended by this Ordinance No. 392, Ordinance No. 372 is ratified and confirmed and remains in full force and effect.
