AN ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT
AMENDING ORDINANCE NOS. 372 AND 373 PROVIDING THAT
DELINQUENT CHARGES AND ALL PENALTIES SHALL CONSTITUTE A LIEN
UPON THE REAL PROPERTY SERVED
The Board of Directors of the South Tahoe Public
Utility District makes the following findings:
1. That Notice of Hearing of this proposed
Ordinance was duly given, authorized, posted, and published as
required by law and specifically, that said Notice fixing the
time and place of hearing on said Ordinance was duly given,
posted, and published as required by Section 54354.5(b) of the
Government Code of California.
2. That pursuant to said Notice of Hearing, a
hearing by the Board of Directors of South Tahoe Public Utility
District on this proposed Ordinance was held at an adjourned
regular meeting of said Board of Directors on February 2, 1989,
at 4:30 p.m. at the place specified in said Notice of Hearing.
3. That following said hearing, the Board of
Directors of South Tahoe Public Utility District determined that
the proposed lien for unpaid rates and charges upon the real
property served are not discriminatory or excessive, will be
sufficient under Section 54515 of the Government Code of
California, will comply with the provisions of Chapter 6,
Revenue Bond Law of 1941, of the Government Code of California,
will be sufficient under the provisions or covenants of any
outstanding revenue bonds of South Tahoe Public Utility District
payable from revenues of the enterprise of said Agency, will be
in compliance with the law, and is an enforcement means
reasonably necessary to collection of delinquent accounts.
NOW, THEREFORE, BE IT ENACTED by the SOUTH TAHOE PUBLIC
UTILITY DISTRICT as follows:
Section 1. Ordinance No. 372 is hereby amended by
amending Section 10.6(c) thereof to read as follows:
"Delinquent charges, together with all
penalties thereon, when recorded as in
Chapter 6, Division 2, of the Government Code
of California, shall constitute a lien upon
the real property served and such lien shall
continue until the charges thereon and
penalties thereon are fully paid or the
property sold therefor in the manner more
particularly provided in Sections 54354,
54354.5, and 54355 of said Government Code of
California."
Section 1. Ordinance No. 373 is hereby amended by
amending Section 8.8(c) thereof to read as follows:
"Delinquent charges, together with all
penalties thereon, when recorded as in
Chapter 6, Division 2, of the Government Code
of California, shall constitute a lien upon
the real property served and such lien shall

continue until the charges thereon and
penalties thereon are fully paid or the
property sold therefor in the manner more
particularly provided in Sections 54354,
54354.5, and 54355 of said Government Code of
California."
Section 3. This Ordinance amends only Section
10.6(c) of Ordinance No. 372 adogted by the Board of Directors
on July 1, 1985, and Section 8.8(c) of Ordinance No. 373 adopted
by the Board of Directors on July 1, 1985. In all other
respects, Ordinances Nos. 372 and 373 are ratified and confirmed
and remain in full force and effect.

Tahoe Publio Utility District at its adjourned regular meeting
on the 2nd day of February , 1989, by
