Ordinance No. 414 - Retired ! 2 3 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 ~6 27 ORDINANCE NO. 414 ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT ADOPTING SEWER ENTERPRISE FUND BUDGET FOR FISCAL YEAR 1989-90 BE IT ENACTED by the Board of Directors of South Tahoe Public Utility District, E1 Dorado County, California, as follows: 1. The Board of Directors finds that prior to adopting this Ordinance, the Board held a public meeting at which time oral and written presentations to the Sewer Enterprise Fund Budget for Fiscal Year 1989-90 were received as a part of a regularly scheduled meeting on April 6, 1989. 2. The Board of Directors further finds that the notice of time and place of said meeting, including a general explanation of the matter to be considered at said meeting and a statement that the data indicating the amount of the cost or estimated cost required to provide sewer service and the revenue source anticipated to provide such service, including general fund revenues is available to the public, was published at least 14 days prior to said meeting. 3. The Board of Directors also finds that at least 10 days prior to said public meeting, said data was available to the public. 4. The Board of Directors further finds that noticed public workshop meetings were held on the afternoon of April 6, 1989, and in the evening of April 3, 1989. 5. The Board of Directors spcifically finds that the sewer service charges being charged are for the following purposes: A. Purchasing or leasing supplies, equipment, or materials; C. Meeting financial reserve needs and requirements; D. Obtaining funds for capital projects necessary to maintain service within existing service areas. The Board of Directors of the South Tahoe Public Utility District hereby determines that the proposed sewer and water connection fee increases contemplated by proposed Ordinance #413 are exempt from the provisions of the California Environmental Quality Act ["CEQA"] pursuant to the provisions of §21080(b) (8) California Public Resources Code and Condit v. Solvang Mun. Improvement Dist., 146 Cal. App. 3d 997 (1983). Generally, Ordinance #413 will increase sewer connection fees to $2,000 per sewer unit from $1,330 pe~ sewer unit and will increase water connection fees to $1,700 from $1,000 for a single family residence. Ordinance #413 is exempt from the provisions of CEQA based upon the following express findings: 1. Each of said increases in connection fees is slightly less than the anticipated cost of providing the respective service. 2. Each of said increases are necessary and appropriate as to both the sewer and water enterprises for each of the following reasons : a. to pay operating expenses of the District; b. to purchase supplies, equipment and materials; c. to meet financial reserve needs; and d. -to obtain funds for capital projects necessary to maintain each of said services within their respective service areas. The operating expenses, supplies to be purchased, reserve needs and funds for potential capital projects all are District financial needs emanating from the service to be provided. 4. The findings of Ordinance #413 are incorporated herein by this reference. 5. No projects related to either the sewer or water enterprises of the District are hereby approved. 6. The funds necessary to conduct the preliminary planning, studies and review necessary to consider and evaluate potential projects including their environmental impacts related to the water and sewer enterprises are, in part, included in the rates imposed by Ordinance #413.
