AN ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT
AMENDING ORDINANCE NUMBER 359 TO PROVIDE
FOR THE INSTALLATION OF LOW WATER USE PLUMBING FIXTURES
FOR NEW CONSTRUCTION AND REMODELING
BE IT ENACTED by the Board of Directors of the SOUTH TAHOE
PUBLIC UTILITY DISTRICT, County of E1 Dorado, as follows:
SECTION I. - FINDINGS
A. The SOUTH TAHOE PUBLIC UTILITY DISTRICT (,'DISTRICT"
herein) Board of Directors has determined that water conservation
is in the best interest of the public and the District is
concurrently considering water conservation standards for new
construction and remodeling.
B. Reducing sewage influent by water conservation will
increase the efficiency of facilities and reduce the cost of
providing sewer services. The specific rules, regulations and
restrictions established herein are necessary and appropriate to
the accomplishment of that end.
C. Treated wastewater is exported out of the District
boundaries and out of the Lake Tahoe watershed at considerable
expense to the public.
SECTION II. - AMENDMENT OF ORDINANCE NO. 359
A. Definition of New Construction. District Ordinance No.
359 is hereby amended by adding Section 1.33 thereto which shall
read as follows:
"Section 1.33. New construction - any structure that
does not exist and for which plans are received by the
District after February 21, 1991."
B. Low Water Use Plumbinq Fixtures. District Ordinance No.
359 is hereby amended by adding Section 1.35 thereto which shall
read as follows:
"Section 1.35. Low Water Use Plumbinq Fixtures includes
all of the following:
Any toilet, urinal or other device which discharges
no more than 1.6 gallons per flush, and incorporates
American National Standards Institute standards.
Flow from lavatory faucets, sink faucets, and
showerheads is not to exceed 2.75 gallons per
minute, plus or minus a ten percent tolerance, at
which pressures up to 80 pounds per square inch.
The words "3.0 gpm max", the actual tested flow
rate, or other conspicuous marking approved by the
Executive Director of the California Energy
Commission shall be marked on the fitting or on a
label attached to the fitting to show compliance
with flow rate standards.
3. Any faucet aerator which discharges no more than
2.75 gallons per minute.
C. Definition of Remodelinq. District Ordinance No. 359 is
hereby amended by adding Section 1.36 thereto which shall read as
follows:
,,Section 1.36. Remodelinq means any construction
activity which increases the livable space under roof on
a parcel and entails an expenditure in excess of $5,000."
D. Low Water Use Plumbinq Fixtures Required for New
Construction and Remodelinq. District Ordinance No. 359 is hereby
amended by adding Sections 7.10 and 7.11 thereto which shall read
as follows:
"Section 7.10. New Construction. Effective February 21,
1991, Low Water Use Plumbing Fixtures are mandatory for
all New Construction. These fixtures shall be installed
and maintained and shall not be replaced with fixtures
which allow greater water use."
"Section 7.11. RemS. At the time of Remodeling,
Low Water Use PlUmbing Fixtures shall be installed in all
buildings. These fixtures shall be installed and
maintained and shall not be replaced with fixtures which
allow greater water use.
SECTION III - SEVERABILITY CLAUSE
A. If any section, subsection , subdivision, paragraph,
sentence, clause, or phrase of this Ordinance, or any part thereof,
is for any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this Ordinance or
any part thereof. The Board hereby declares that it would have
passed each section, subsection, subdivision, paragraph, sentence,
clause, or phrase thereof, irrespective of the fact that any one
or more sections, subsections, subdivisions, paragraphs, sentences,
clauses, or phrases be declared invalid.

B. Supersedes Former Ordinances. This Ordinance amends
Ordinance No. 359. Except as that Ordinance has been amended by
subsequently adopted District ordinances, including this Ordinance,
Ordinance No. 359 remains in full force and effect.
PASSED AND ADOPTED by the Board of Directors of the South
Tahoe Public Utility District at its duly held Regular Meeting on
the 21st day of February, 1991, by the following vote:
