AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE
SOUTH TAHOE PUBLIC UTILITY DISTRICT SUPERSEDING
PARAGRAPH 2 OF ORDINANCE 442, PROVIDING
FOR COMPENSATION PROVISIONS OF THE
CLERK OF THE BOARD/GRANT ADMINISTRATOR
OF SOUTH TAHOE PUBLIC UTILITY DISTRICT
WHEREFORE, Agreement on the Management Memorandum of
Understanding (hereinafter referred to as the "MOU") effective
January 1, 1994, between the District and Management Employees, was
not finally attained until June 2, 1994, and has not yet been
signed by all the parties;
AND WHEREFORE, the Clerk of the Board/Grant Administrator was
not an active participant in the negotiations between the DiZstrict
and Management Employees resulting in the MOU;
AND WHEREFORE, the Clerk of the Board/Grant Administrator is
subject to the terms and conditions of the MOU;
AND WHEREFORE, the delay and changes occurring as a result of
the MOU negotiations substantially impacted continuing compensation
and benefits to the Clerk of the Board/Grant Administrator;
AND WHEREFORE, further negotiation between the Clerk of the
Board/Grant Administrator and the District is deemed necessary and
appropriate in the circumstances;
AND WHEREFORE, further discussions between the Clerk of the
Board/Grant Administrator and the District have occurred therefore;
BE IT ENACTED, by the Board of Directors of the South Tahoe
Public Utility District, County of E1 Dorado, State of California,
as follows:
(1) That the present CLERK OF THE BOARD/GRANT ADMINISTRATOR,
as an officer of the SOUTH TAHOE PUBLIC UTILITY DISTRICT, shall
receive as compensation for said office, the sum of FOUR THOUSAND
THREE HUNDRED NINETY-TWO DOLLARS and SIXTY-SEVEN CENTS ($4,392.67)
PER MONTH, retroactive to January 3, 1994. This shall be a Class
(5) position.
(2) As and for additional compensation, DISTRICT agrees to
reinstate the equivalent in sick-leave hours expended by the
present CLERK OF THE BOARD/GRANT ADMINISTRATOR that would have
otherwise been paid by the Long-Term Disability Plan during 1994
had management contract negotiations not delayed the benefit
package of officers of the Board. The District further agrees to
self-insure the present CLERK OF THE BOARD/GRANT ADMINISTRATOR for
long-term disability benefits (including the COLA adjustments)
governed by the terms and conditions associated with the Long Term
Disability Plan negotiated in the current Management MOU by
management staff, to cover the pre-existing condition that occurred
during Management negotiations. The District will maintain the
Management health insurance coverage for the CLERK OF THE
BOARD/GRANT ADMINISTRATOR during any period of disability up to a
maximum of 5 years to coincide with, and in addition to, the Long-
Term Disability Plan.
(3) That this Ordinance No. 449 shall remain in full force
for a period of 5 years from 2/1/94 or until the current CLERK OF
THE BOARD/GRANT ADMINISTRATOR may become covered by the Long-term
Disability Plan or until the present CLERK OF THE BOARD/GRANT
ADMINISTRATOR is deceased, whichever occurs first.
(4) That the Management insurance coverage may change and, if
so, shall coincide with the coverage offered to the Management
staff during the 5 year period noted above. Changes to insurance
coverage will include any changes brought about by a National
Health Insurance program instituted by the Federal government.
(5) That this Ordinance No. 449 supersedes Paragraph Two
Ordinance No. 442.
THIS ORDINANCE shall take effect thirty (30) days after its
passage. One (1) week after Board Approval, copies of said
ORDINANCE shall be posted by the Clerk of the Board of the South
Tahoe Public Utility District, at four public places in said
District, and one week after Board approval, this ORDINANCE shall
be published in the Tahoe Daily Tribune, a newspaper of general
circulation, printed and published in said District one time.
PASSED AND ADOPTED at a duly held Regular Meeting of the Board
of Directors of the South Tahoe Public Utility District on the 21st
day of July, 1994 by the following vote:
