Ordinance No. 454 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 ORDINANCE NO. 454 AN ORDINANCE AMENDING ORDINANCE NO. 360 OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT ESTABLISHING RESIDENTIAL METERED WATER RATES The Board of Directors of South Tahoe Public Utility District makes the following findings: 1. Notice of Hearing of this proposed Ordinance was duly given, authorized, Posted, and published as required by law and specifically, that said Notice fixing the time and place of hearing on said Ordinance was duly given, posted, and published as required by Government Code of California. 2. Pursuant to said Notice of Hearing, a hearing by the Board of Directors of South Tahoe Public Utility District on this proposed ordinance was held at a regular Board meeting of said Board of Directors on May 18, 1995 at the place specified in said Notice of Hearing. 3. The current water rate schedule provides for an annual flat rate water service charge for all single family dwellings in the District's service area. Said single rate may result in some degree of inequity for customers who own a small home with little or no landscaping, or out-of-town customers who seldom use their second home. 4. The District's published minimum metered water service rate (3/4") is established for commercial connections. NOW, THEREFORE, BE IT ENACTED by the SOUTH TAHOE PUBLIC UTILITY DISTRICT as follows: SECTION I The District hereby establishes a minimum residential metered rate (3/4") equal to the current 3/4" commercial metered rate; consumption shall be charged at the same rate charged all metered customers of the District. A. The rate shall apply to existing residential customers opting to convert to the metered residential rate and to new owners of residential development wishing to establish a metered residential rate pursuant to subsection 1.C. herein. 28 1 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Ordinance No. 454 Page 2 B. The minimum residential metered rate shall be available to all existing residential customers as an alternative to the flat rate residential water service rate. C. The option of existing customers to convert to the metered residential rate at a specific property is permanent and cannot be rescinded. D. The applicant shall be responsible for the cost and installation of meter. Said meter shall be of a design approved by the District; installation shall be made according to current District specifications. E. The property owner shall maintain access to the meter year around. Where access is not possible, the District shall estimate consumption. SECTION II Where the. water line size of new or existing residential development is larger than 3/4", said new residential development will be charged the current metered rate for such line size; or in the case of existing property owners, shall have the option to convert to the appropriate metered rate subject to all other provisions of Section 1 above. SECTION III The District shall begin billing the metered residential rate on the normal billing cycle following inspection and approval of the meter installation. SECTION IV Except as Ordinance No. 360 is hereinabove expressly amended, all sections of said ordinance are ratified and confirmed, and shall remain in full force and effect. SECTION V If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, or any part thereof, is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance or any part thereof.
