AN ORDINANCE OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT ADOPTING
A COMPREHENSIVE ADMINISTRATIVE CODE OF THE DISTRICT'S
ADMINISTRATION, WATER, SEWER AND STREET LIGHTING ORDINANCES
BE IT ENACTED, by the Board of Directors of the South Tahoe Public Utility District, County of
El Dorado, California, as follows:
SECTION 1. Policy and Purpose; Citation.
The purpose of this Ordinance is to adopt the South Tahoe Public Utility District
(District) Administrative Code (Administrative Code) which is a compilation and codification of all
of the administration, water, sewer and street lighting ordinances of the District. It shall be sufficient
to designate any ordinance enacted or adding to, amending, correcting or repealing all or any part or
portion of any District ordinance as an addition to, amendment to, correction of or repeal of the
provisions of the Administrative Code. Further reference in any ordinance may be had to the titles,
sections and subsections of the Administrative Code and such reference shall apply to that numbered
title, section or subsection as it appears in the Administrative Code.
SECTION 2. Provisions Considered as Continuation of Existing Ordinances.
The provisions appearing in the Administrative Code, so far as they are the same as
those ordinances existing at the time as of the effective date of the Administrative Code, shall be
considered as continuations of those ordinances and not as new enactments. The compilation and
codification of the District's existing ordinances are exempt from further environmental review under
the California Environmental Quality Act and Title 14, Section 15061 of the California Code of
Regulations as there is no possibility that the compilation and codification may have a significant
effect on the environment.
SECTION 3. Repeal of Ordinances.
To effectuate the consolidation and compilation of ordinances into the Administrative
Code, the following ordinances are hereby repealed: 66, 181,207, 288, 293 and 449.
SECTION 4. Codification Authority and Adoption.
Any and all ordinances now or hereafter passed by the Board of Directors of the
District, and which have not been repealed, may be compiled, revised, indexed and arranged as a
comprehensive Administrative Code. The Administrative Code shall contain all of the regulatory and
administration ordinances of the District and is compiled, adopted and codified pursuant to sections
16702-16084 of the Public Utilities Code.

SECTION 5. Reference Applies to all Amendments.
Whenever a reference is made to the Administrative Code or to any portion thereof,
or to any administration, water, sewer or street lighting ordinance of the District, the reference shall
apply to all amendments, corrections and additions now or hereafter made to the Administrative
Code.
SECTION 6. Title~ Division and Section Headim, s.
Title, division and section headings contained in the Administrative Code shall not be
deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions
of any title, division or section of the Administrative Code.
SECTION 7. Reference to Specific Ordinances.
The provisions of the Administrative Code shall not in any manner affect matters of
record which refer to, or are otherwise connected with, ordinances which are specifically designated
by number, but such reference shall be construed to apply to the corresponding provisions contained
within the Administrative Code.
SECTION 8. Effect of Code on Past Actions and Obli~,ations.
Neither the adoption of the Administrative Code nor the repeal or amendment of any
ordinance or part or portion of any ordinance of the District shall in any manner affect the prosecution
for violations of ordinances, which violations were committed prior to the effective date of the
Administrative Code, nor be construed as a waiver of any permit, license, fee or penalty at the effec-
tive date due and unpaid under such ordinances, nor be construed as affecting any of the provisions
of such ordinances relating to the collection of any such permit, license, fee or penalty, and all rights
and obligations appertaining shall continue in full force and effect.
SECTION 9. Severabilit¥.
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this
Ordinance and its implementing rules and regulations and the Administrative Code incorporated by
this reference, or any part thereof} is for any reason held to be unconstitutional or invalid, such
decision shall not affect the validity of the remaining portions of this Ordinance or the Administrative
Code. The Board of Directors hereby declares and determines that it would have passed each
section, subsection, subdivision, paragraph, sentence, clause or phrase thereof of this Ordinance and
its implementing rules and regulations and the Administrative Code irrespective of the fact that any
one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases may be
determined to be unconstitutional or invalid.

SECTION 10. Publication.
The Administrative Code and any revisions, amendments, corrections or repeals to it
shall be published annually. A certified copy of the Administrative Code shall be filed in the office
of the Clerk of the District and shall be available for public review during normal business hours.
Copies of the Administrative Code shall be available for purchase by the public at a price equal to the
actual cost to the District of copying the document.
SECTION 11. Effective Date.
This Ordinance and the Administrative Code incorporated by this reference shall take
effect thirty (30) days after its passage.

District at its duly held regular meeting on the 1st day of May, 1997 by the following vote:
