Resolution No. 12181 2 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 24 25 26 27 28 29 50 51 J~... ~.WEIDMAN PL~ERVILL£, CA RESOLUTION NO. /~ / ~ A RESOLUTION OF THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC UTILITY DISTRICT MAKING DETERMINATIONS aND APPROVING THE PROPOSED aNNEXATION OF TERRITORY DESIGNATED AS "SOUTH TAHOE PUBLIC UTILITY DISTRICT aNNEXATION NO. 1968-3" TO THE SOUTH TAHOE PUBLIC UTILITY DISTRICT RESOLVED, by the Board of Directors of South Tahoe Public Utility District, County of E1 Dorado, State of California~ as follows: WHEREAS, on August 29, 1968, the SOUTH TAHOE PUBLIC UTILITY DISTRICT adopted its Resolution No. 1145, entitled "A Resolution of Application by South Tahoe Public Utility Distric~ Requesting that Local Agency Formation Commission Take Proceeding for Annexation of Territory to the South Tahoe Public Utility District" a mandatory resolution, which said resolution described territory proposed to be annexed to said District and which said resolution was filed with the Executive Officer of the Local Agency Formation Commission of the County of E1 Dorado; and WHEREAS, on October 16, 1968, the Local Agency Formation Commission adopted its Resolution No. 12-68, entitled "A Resolutio of the Local Agency Formation Commission of the County of E1 Dorado Making Determinations and Approving the Proposed Annexation] of Territory, Designated as south Tahoe Annexation No. 1968-3, to the South Tahoe Public Utility District", which said Resolution No. 12-68 approved the annexation of territory proposed to be annexed, as described in said Resolution No. 1145 of the SOUTH TAHOE PUBLIC UTILITY DISTRICT; and WHEREAS, on October 17, 1968, the SOUTH TAHOE PUBLIC UTILITY DISTRICT adopted its Resolution No. 1212, entitled "A Resolution of the Board of Directors of South Tahoe Public Utility District Initiating Proceedings for Annexation of Territory to the South Tahoe Public Utility District, and Fixing Time, Date and 1 2 5 4 5 6 7 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 24 25 26 27 28 29 30 51 JL . ~oWEID~AN Place of Hearing on the Proposed Annexation Designated as "South Tahoe Public Utility District Annexation No. 1968-3" to the Tahoe Public Utility District", which said resolution described territory proposed to be annexed which was described in said Resolution No. ll4~ of SOUTH TAHOE PUBLIC UTILITY DISTRICT, and said Resolution No. 12-68 of the Local Agency FoEnation Commissio of E1 Dorado County; and WHEREAS, notice of time, date and place of hearing on said proposed annexation was published, posted and mailed by the Clerk of SOUTH TAHOE PUBLIC UTILITY DISTRICT in the manner provid~ by law and as ordered by said Resolution No. 1212; and WHEREAS, a hearing was held pursuant to said Resolution No. 1212 at the time, date and place fixed for said hearing, to wit: Eight o'clock P. Mo, November 19, 1968, at the South Tahoe Public Utility District Office, Johnson Road, near Black Bart, South Lake Tahoe, E1 Dorado County, California; and WHEREAS, said Local Agency FoEnation Commission's Resolution No. 12-68 was read aloud or summarized at the hearing of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT prior to consideration of protests; and WHEREAS, the Board of Directors considered all matters at said hearing required to be considered by Sections ~6314.1 and ~6~1~ of the Government Code of the State of California and all other matters required by law; and WHEREAS, at said hearing any oral protests, written protests, objections or evidence made, presented or filed to the proposed annexation or to the approval of the teens and conditions hereinafter set forth of said proposed annexation were heard by the Board of Directors; and WHEREAS, there were written protests filed and not withdrawn in accordance with the provisions of Section ~6~17 of said Government Code and the sufficiency thereof deteenined e 1 2 4 5 6 ? 8 9 10 11 12 14 15 16 17 18 19 20 21 25 24 25 26 27 28 29 50 ,.Il. ~. WEIDMAN pursuant to Sections 56318, 56158 and 56162 of the Government Code; and WHEREAS, said written protests filed and not withdrawn prior to the conclusion of the hearing represented less than 25 percent of the number of land owners within such territory proposed to be annexed owning not more than 25 percent of the assessed value of land therein, and less than 25 percent of the voting power of voters entitled to vote as a result of residing in or owning property within such territory proposed to be annexe( NOW, THEREFORE, IT IS ORDERED A~ FOLLOWS: 1. That the annexation of territory described in Resolution No. 1145 of SOUTH TAHOE PUBLIC UTILITY DISTRICT, and Local Agency Formation Commission of E1 Dorado County Resolution No. 12-68, and Resolution No. 1212 of SOUTH TAHOE PUBLIC UTILITY DISTRICT, is approved and ordered annexed to the sOUTH TAHOE PUBLIC UTILITY DISTRICT, County of E1 Dorado, State of California. without an election therefore. 2. The boundaries of said District are hereby changed by including the territory described in said resolutions. 3. That the territory so annexed and the exterior boundaries thereof are more particularly defined and established as set forth in EXHIBIT A attached hereto and by reference made a part hereof. 4- That the terms and conditions of said annexation are those as set forth in EXHIBIT B, attached hereto and by reference made a part hereof.
