RESOLUTION NO. 1360
A RESOLUTION PERTAINING TO AGREEMENT BETWEEN
U. S. DEPARTMENT OF AGRICULTURE, FOREST
SERVICE, AND SOUTH TAHOE PUBLIC UTILITY
DISTRICT, EXECUTED AS OF SEPTEMBER 15, 1969
ASSESSMENT DISTRICT 1968-3F
RESOLVED, by the Board of Directors of the South Tahoe Public
Utility District, E1 Dorado County, California, that
WHEREAS, this public utility district has entered into an
agreement with the United States Department of Agriculture, Forest
Service (hereinafter referred to as "U.S."), executed as of SePtem-
ber 15, 1969, pertaining to lands included within this public
utility district's Assessment District 1968-3 which are owned by
UoSo and upon which lands there are recreation residence buildings
constructed, owned and maintained by private individuals under and
subject to written permission granted by U.So by documents entitled
"Term Special Use Permit" (hereinafter referred to as "permits");
WHEREAS, pursuant to said agreement U.S. has issued new per-
mits for all of said lands, in which permits changes were made in
the form of permit attached to said agreement as Exhibit A, as
follows: deletion of clause 17 and revision of clause 18 as con-
tained in said form of permit attached to said agreement as
Exhibit A;
WHEREAS, paragraph 4(a) of said agreement provides that
STPUD shall consent in writing to any variations in said permits
from said form attached to said agreement as Exhibit A (except as
to var~ations expressly provided for in said agreement);
WHEREAS, deletion of said clause 17 results in new numbers
for the clauses following clause 17, so that clause 21 as referred
to in paragraph 3(b) of said agreement actually refers to clause
20 in said new permits issued by U.S. pursuant to said agreement;
W~HEREAS, by Resolution NOo 1B49, adopted by this Board on Nov-
ember 6, 1969, certain territory has been excluded from the proceed-
ings for said Assessment District 1968-B and the designation of
said assessment district has been changed to Assessment District
1968-BF, all as reflected in said resolution and in a new map show-
ing proposed boundaries of Assessment District 1968-BF filed in the
office of the Clerk of this public utility district on November 6,
1969;
NOW~ THEREFORE~ IT IS ORDERED as follows:
lo That consent of this public utility district be, and is
hereby~ given to the aforesaid variations in the permits issued by
UoSo pursuant to said agreement;
2o That by reason of the aforesaid variations in said per-
mits and the aforesaid change in designation and boundary map for
said a~sessment district, it is understood and agreed by this
public utility district that said agreement pertains to the assess-
ment district now designated as Assessment District 1968-3F and
t~at c~Lause 21 as referred to in paragraph B(b) of said agreement
refers to clause 20 in said new permits issued by U~S~ pursuant
to said agreement;
Bo That request be, and is hereby, made of UoSo to confirm
its understanding and agreement that said agreement pertains to
the as.~essment district now designated as Assessment District
1968-3~ and that clause 21 as referred to in paragraph 3(b) of said
agreement refers to clause 20 in said new permits issued by UoSo
