Resolution No. 1376 RESOLUTION NO. 1376 A RESOLUTION AUTHORIZING THE GENERAL MANAGER TO EXECUTE A RIGHT OF WAY AGREEMENT RESOLVED, by the Board of the SOUTH TAHOE PUBLIC UTILITY DISTRICT, County of E1 Dorado, State of California, as follows: WHEREAS, the PACIFIC TELEPHONE and TELEGRAPH COMPANY has requested an easement for their communication facilities, and WHEREAS, the PACIFIC TELEPHONE and TELEGRAPH COMPANY agrees to grant easements to the SOUTH TAHOE PUBLIC UTILITY DISTRICT as may be required by the SOUTH TAHOE PUBLIC uTILITY DISTRICT for consideration of executing the agreement hereinafter described. NOW, THEREFORE, IT IS ORDERED, as follows: That the General ~/Ianager of the SOUTH TAHOE PUBLIC UTILITY DISTRICT is authorized to execute the right of way agreement as set forth tn Schedule A, attached hereto and by reference made a part hereof. Callahan, Clerk and Ex-officio Secretary of the Board SOUTH TAHOE PUBLIC UTILITY DISTRICT SOUTH TAHOE PUBLIC UTILITY DISTRICT Grantor, hereby grants to THE PACIFIC TELEPHONE AND TELEGRAPH COMPANY, a corporation, its successors and assigns, Grantee, the right from time to time to construct and maintain communication facilities, consisting of aerial and underground wires, cables and other electrical conductors with associated poles, anchors, guys, fixtures, conduits, manholes, marker posts above ground and other appurtenances, together with a right of way therefor and with the right of ingress thereto and egress therefrom, across, upon, tn and under the following described real property in the County 'of E1 Dorado, State of California: That portion of the West half (W 1/2) of Lot 6, Section 3, Town- ship 12 North, Range 18 East, M.D.B.and M., more particularly described as follows: A strip of land five (5) feet in width the centerline of which ts described as follows: Commencing at a point on the North line of said Lot 6, from which the Northwest corner of said Lot 6 bears South 89° 49'30" West 458.91 feet; thence South 3~°00'39'' East 421.57 feet, more or less, to the Westerly corner of that certain real property described in and conveyed by deed from Charles R. Link, et ux, to South Tahoe Public Utility District, dated July 20, 1959, and recorded in Book 482, page 534 of the Official Records of E1 Dorado County; thence South 37° 00'39" East 2.5 feet; thence North 53°21'15TM East 96.48 feet to the true point of beginning of the herein described centerline; thence North 53° 21 '15" East 35.5 feet; thence' North 36° 38'45" West 2.5 feet; thence South 36° 38'45" East 70 feet to the point of termination on the Southeasterly line of said real Property. Provided, that the South Tahoe Public Utility District (S.T.P.U.D.) reserves the right to construct, operate and maintain its facilities within said right-of-way. Provided further, thatThe Pacific Telephone and Telegraph Company agrees to hold the S.T.P.U.D. harmless for any and all damages to Pac.ific Telephone and Telegraph Company facilities within said right-of-way, and will, upon request by the S.T.P.U.D., excavate and expose Pacific Telephone and Telegraph Company's underground facilities within said right-of-way, tn order to reduce the possibility of damage by the S.T.P.U.D.
