The South Tahoe Public Utility District Board of Directors regularly meets the first and third Thursday of each month.

ITEM - PROJECT NAME: Geo-Referencing Survey Services - Phase II
REQUESTED BOARD ACTION: Approve increasing the total for Purchase Order No.
P13895 to the amount of $85,440.
DISCUSSION: In August 2003, the Board approved a proposal from Tri-State
Surveying, Ltd. (Tri-State), in the amount of $71,010, to provide surveying services as
outlined in their cost estimate dated July 14, 2003. These services were requested to
locate and provide point location information for up to 2,000 selected sewer and water
utility assets within the District service area. Tri-State completed the geo-referencing
survey with delivery of the final point location coordinates files in November 2004.
During the conduct of this work, additional crew time was required to complete the
project. Following completion of the project, Tri-State and District staff have been
working together in determining the portion of this added crew time that was incurred
due to unforeseen circumstances encountered in the field. Based on this work, staff
believes that Tri-State is justified in requesting that $14,430 be added to the current
purchase order total and recommends that the Board approve the requested increase.

Over the past several months I have been working with Barbara Littell (Tri-State Surveying, Ltd.)
and yourself to determine the hours and costs added to the Geo-referencing survey. Based on a
thorough review of the survey data and field notes (by Barbara), I believe that Tri-State
Surveying is justified in requesting that $14,430.00 be added to the current contract amount.
Therefore, I recommend that the District raise the total contract for Purchase Order P13895 to
$85,440.00. A breakdown of these added costs are provided in the following table.

I would appreciate a current map of your District boundaries; however, if you complete the form
stating that there have been no annexations of parcels or deletions of parcels from your District
boundaries since December 2003- that will be sufficient. It is important that this department be
aware of EVERY addition or deletion to your District boundaries. If there have been changes,
you will need to obtain a current map from LAFCO, with an approved LAFCO stamp on it.
There is a fee for such maps.
If appointments to fill vacancies have been made by your Board since the last Consolidated
Districts Election (November 4, 2003), please keep in mind that appointees only hold.office until
the next Consolidated Districts Election (November 8, 2005). If the term is unexpired, it shall

If your District wishes to place a measure on the ballot for the Consolidated Districts Election,
your Board of Directors must adopt a resolution calling for the MEASURE election and setting
forth the measure EXACTLY as it is to appear on the ballot. This resolution must be submitted
to the Elections Department NO LATER THAN 5:00 P.M. on July 6, 2005. This will enable
publications to take place in a timely manner.

INSTRUCTION:
The qualifications of a nominee and of an elective officer of a district are determined by the principal
act of that district. (Elections Code Section 10514) Generally, the qualification for a resident voting
district is "resident elector within the district or division thereof, if any," and the qualification for a
landowner voting district is "resident and freeholder within the district or division thereof, if any."
NOTE: FPPC Regulations Section 18530, effective October 10, 1990, ruled that districts can pay for
"production and dissemination of candidates statements" notwithstanding Government Code Section
85300 which forbids use of "public money for promoting candidacies."

election and shall either be delivered in person or mailed by certified mail in time to reach the

13307. Preparation and form of candidate statement.
(a) (1) Each candidate for nonpartisan elective office in any local agency,
including any city, county, city and county, or district, may prepare a
candidate ts statement on an appropriate form provided by the elections official.
The statement may include the name, age and occupation of the candidate and a
brief description, of no more that 200 words, of the candidate es education and
qualifications expressed by the candidate himself or herselfi However, the
governing body of the local agency may authorize an increase in the limitations
on words for the statement from 200 to 400 words. The statement shall not
include the party affiliation of the candidate, nor membership or activity in
partisan political organizations.
(2) The statement authorized by this subdivision shall be filed in the office
of the elections official when the candidate es nomination papers are returned
for filing, if it is for a primary election, or for an election for offices for which
there is no primary. The statement shall be filed in the office of the elections
official no later than the 88th day before the election, if it is for an election for
which nomination papers are not required to be filed. Ifa runoff election or
general election occurs within 88 days of the primary or first election, the
statement shall be filed with the elections official by the third day following the
governing body's declaration of the results from the primary or first election.
(3) Except as provided in section 13309, the statement may be withdrawn,
but not changed, during the period for filing nomination papers and until 5p.m.
of the next working day after the close of the nomination period.
(b) The elections official shall send to each voter, together with the sample
ballot, a voteres pamphlet which contains the written statements of each
candidate that is prepared pursuant to this section. The statement of each
candidate shall be printed in type of uniform size and darkness, and with
uniform spacing. The elections official shall provide a Spanish translation to
those candidates who wish to have one, and shall select a person to provide that
translation from the list of approved Spanish language translators and
interpreters of the superior court of the county or from an institution accredited
by the Western Association of Schools and Colleges.
(c) The local agency may estimate the total cost of printing, handling,
translating, and mailing the candidate's statements filed pursuant to this
section, including costs incurred as a result of complying with the federal
Voting Rights Act of 1965, as amended. The local agency may require each
candidate filing a statement to pay in advance to the local agency his or her
estimated pro rata share as a condition of having his or her statement included

in the voter's pamphlet. In the event the estimated payment is required, the
receipt for the payment shall include a written notice that the estimate is just an
approximation of the actual cost that varies from one election to another
election and may be significantly more or less than the estimate, depending on
the actual number of candidates filing statements. Accordingly, the elections
official is not bound by the estimate and may, on a pro rata basis, bill the
candidate for additional actual expense or refund any excess paid depending on
the final actual cost. In the event of underpayment the elections official may
require the candidate to pay the balance of the cost incurred. In the event of
overpayment, the elections official shall prorate the excess atnount among the
candidates and refund the excess amount paid within 30 days of the election.
(d) Nothing in this section shall be deemed to make any statement or the
authors thereof free or exempt from any civil or criminal action or penalty
because of any false, slanderous, or libelous statements offered for printing or

AN AMENDMENT TO THE SOUTH TAHOE PUBLIC UTILITY DISTRICT'S
ORDINANCE NO. 464 - ADMINISTRATIVE CODE SECTIONS 3.1.49 AND
3.1.50 WATER RATE SCHEDULES, AND SECTION 4.5.12 SEWER RATE
SCHEDULE, AND SUPERSEDING WATER AND SEWER RATE ORDINANCE
NO. 483-02 IN ITS ENTIRETY
The Board of Directors of the South Tahoe Public Utility District, E1 Dorado
County, State of California, makes the following findings:
1. Public Meeting of this Ordinance was duly given, authorized, posted and
published, as required by law and specifically, that said Notice fixing the time and place
of the hearing on said Ordinance was duly given, posted, and published, as required by
Government Code of California.
2. Pursuant to said Public Meeting, a meeting by the Board of Directors of
the South Tahoe Public Utility District (District) on this Ordinance for the public by the
Board of Directors on April 28, 2005, at 6:00pm at the place specified in said Notice of
Public Meeting.
3. The Notice of time and place of said meeting, including a general
explanation of the matters to be considered at said meeting was published on April 7,
2005 and April 21, 2005.
4. At least ten (10) days prior to said public meeting, the data indicating the
amount of the cost or estimated cost required to provide water and sewer services for
which service charges are proposed for adoption pursuant to this Ordinance, and the
revenue source(s) anticipated to provide such service was available to the public.
WATER RATES
5. The water service charges in Schedules No. 2 and 3 will be effective July
1, 2005 and are for the following purposes:
a. Obtaining funds for capital projects necessary to maintain service for
existing customers;
b. Meeting debt service requirements;
c. Meeting operating expenses;
d. Purchasing or leasing equipment, supplies or materials;
e. Meeting financial reserve needs and requirements.
6. The existing water service charges and the increase in the consumption
charge are necessary to meet the costs and expenses enumerated in paragraph 5 herein
above, and are included in the water budget adopted on May 19, 2005.
NOW, THEREFORE, BE IT ENACTED BY THE SOUTH TAHOE PUBLIC
UTILITY DISTRICT BOARD OF DIRECTORS THAT ORDINANCE NO. 483-02 IS

ITEMS FOR BOARD ACTION
Jim Hoggatt reported three bids were received for this
project at the April 14 bid opening. Bids ranged from
$9,498,000 to $10,100,000, with only 0.3% difference
between the lowest and second lowest bid, and only
6% difference between the lowest and highest bid (which
indicates good, competitive bids). The lowest bid exceeded
the budgeted amount by $2,776,000. Staff met with the
Board Building Ad Hoc Committee to evaluate the bids
and budget. Several financing options were identified and
reviewed with the Board. Since the current building
does not meet current building standards for snowload,
earthquake, and ADA, the "do nothing" option was not
feasible. The market is demanding higher prices for this
type of work, and costs are not likely to decrease. Staff

recommended the bid be awarded to the lowest bidder.
Financing options will be presented for the Board's
consideration/action at a future Board meeting.
Moved Mosbacher / Second Jones / Passed Unanimously
to award the bid to the lowest responsive, responsible
bidder, Roebbelen Contracting, Inc., in the amount of
$9,498,000.
A claim was submitted against the District by B. Jett and
K. Pearce in the amount of $600,000 for claimed damages
to their home located at 3740 Grass Lake Road (resulting
from the October 2004 B-line leak). Staff has been
unsuccessful in trying to informally resolve this claim and
does not believe the District is responsible for the damages
claimed.
Note: The Board discussed the specific merits of the
claim in Closed Session. Board action was taken in open
session after Closed Session was held. (See Page 5.)
President Schafer opened the Public Hearing at 2:35 p.m.
Lisa Coyner reported District customers are currently
charged to have their water turned on/off during regular
working hours. If snow removal is necessary or the request
for a service call is received after regular working hours,
the cost can escalate greatly. There are also increased
fees for service calls received during District holidays.
Staff recommended the Administrative Code be amended
to include rate schedules for these service calls in order to
provide clear information to customers. It should also be
noted that current policy dictates that the service charge is
waived should the property owner install a customer service
shut off valve. In order to encourage new construction to
install this valve, the amount waived will be increased.
No public comments were received. The Public Hearing
was closed at 2:50 p.m.

to approve payment in the amount of $1,316,343.78.
Planning Committee: The committee met April 21 to
discuss the feasibility of allowing the El Dorado County
Search and Rescue Team to use the District's building
on Santa Fe (that was formerly occupied by Charter
Communications). The committee concluded this
arrangement would be acceptable. Rhonda McFarlane
will prepare a three-year agreement with automatic
one-year rollover each year, which will be place on a
future agenda for the Board's consideration/approval.
Director Mosbacher reported she received notice from
Alpine County of an error in their billing system that
resulted in them not invoicing the District over the past
four years for the $15,000 per year monitoring charge.
District staff will work with them on a method that will
ensure these payments are made automatically.
Director Jones reported on two items:
1) He will not attend the May 5 Board meeting since he
will be at an ACVVA conference.
2) The Energy Bill will be voted on by the House soon.
Several associations representing water companies will
protest, claiming that the bill amounts to another
unfunded mandate.
Legal Counsel: Gary Kvistad reported on two items:
1) A Senate bill has been introduced regarding pubic
officials who serve on more than one board.
2) CalEPA is pushing state and regional water
quality control boards to step up their enforcement
actions, and to start implementing criminal and civil
penalties for serious violations.

Point presentation on the 2005/06 Fiscal Year Budgets
for the Sewer and Water Enterprise Funds. Planned
revenue and expenditures were explained.

McFarlane and Sciuto responded to several
comments from the audience on projects not
related to the 2005106 Fiscal Year or forecasted

Director Mosbacher reported on two items:
1) Fish and Game's fish planting plan in Alpine County
is very controversial.
2) Alpine County is being confronted by established
businesses and residents who want a portion of the
County's sewer capacity reserved for them.
BOARD MEMBER REPORTS
Vice President Wallace reported on two items:
1) The District's Washington D.C. lobbyist spoke
to Congressman Doolittle about TMDL issue in
Alpine County.
2) It is likely the Energy Bill will pass the House with
the safe harbor language included.

General Manager: Richard Solbrig reported on four items:
1) The CASA conference he recently attended was
very informative. Topics included: medical insurance costs,
trends, employment law, legislative issues, CMOM,
asset management, and peak power usage.
2) California Special Districts Association is hosting a
government affairs days on May 16 & 17. Board members
were invited to attend.
3) The QualServe process is still being utilized by the District.
The committee is currently working on analyzing the
benchmarking comparisons that were below average.
4) TRPA has requested the Board's permission to build
an air quality monitoring station at the Glenwood well site.
The Planning Committee will consider their request.
GENERAL MANAGER REPORTS
Legal Counsel: Gary Kvistad reported an engineering
consultant prepared an evaluation of the Lukins Water
System. An ad hoc committee (Wallace/Comte) was
appointed to work with staff to determine the feasibility
of acquiring the system.
