Resolution 2777-03 Rescinded ... RESOLUTION NO. 2777-03 A RESOLUTION OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT AUTHORIZING AN EXEMPTION FROM COMPETETIVE BIDDING PROCEDURES \.., WHEREAS, the South Tahoe Public Utility District (District) provides domestic water service to the City of South lake Tahoe and portions of EI Dorado County; and WHEREAS, the District recently lost water production from some of its wells due to expanding plumes of MTBE contamination; and WHEREAS, during the District's development of two new wells, one at the Flagpole site and the other at the Elks Club site, it was determined that the Flagpole well was not feasible due to high levels of arsenic, which resulted in the Flagpole well not being completed; and WHEREAS, the loss of water production and not being able to develop two new wells will prevent, or make it extremely difficult for, the District to meet the water supply needs of its customers next summer unless additional water supplies can be brought on-line before that time; and WHEREAS, the District investigated and pilot tested various treatment systems to determine which would best remove MTBE from contaminated groundwater supplies; and WHEREAS, the granular activated carbon treatment process developed by U. S. Filter was determined to be the best technology for removing MTBE from surrounding contaminated groundwater at the current and anticipated levels at the Bakersfield well; and WHEREAS, the construction and installation of an MTBE treatment system at the Bakersfield well is a public work and subject to the District's statutory competitive bidding requirements; and WHEREAS, substantial evidence has been provided to the District which demonstrates that the granular activated carbon process developed by U.S. Filter is unique, that competitive bidding would not effect the final result, and that competitive bidding would not produce an advantage to the District. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: ~ 1. The District is exempt from bidding the construction and installation of an MTBE treatment system at the Bakersfield well since the granular activated carbon \., '-' '-' Resolution No. 2777-03 Page 2 process developed by US Filter is unique, that competitive bidding would not effect the final result, and that competitive bidding would not produce an advantage to the District. 2. The District is authorized and directed to negotiate a contract with US Filter for construction and installation of an MTBE treatment system at the Bakersfield well. 3. This resolution shall take affect immediately. We, the undersigned, do hereby certify that the above and foregoing resolution was duly and regularly adopted and passed by the Board of Directors of the South Tahoe Public Utility District at a regular meeting duly held on the 18th day of September, 2003, by the following vote: AYES: Directors Wallace, Jones, Schafer, Comte NOES: None ABSENT: Director Mosbacher
