RESOLUTION NO. 2726-01
A RESOLUTION OF THE BOARD OF THE DIRECTORS
OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT OF
ADOPTION OF A NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT
WHEREAS, the South Tahoe Public Utility District ("District") is considering the
acquisition of certain property owned by F. Heise Land & Livestock Company, Inc.,
encompassing 1,442.92 acres located on Diamond Valley Road in eastern Alpine County,
8 California ("Property");
9 WHEREAS, the District is developing a Master Plan for Recycled Water Facilities
10 which are located in Alpine County;
11 WHEREAS, the District is considering acquisition of the Property for future use for
12 the recycled water disposal system improvement purposes and acquisition of water rights
13 but no change in use of the Property will be undertaken until completion of the Master Plan
\.., 14 for Recycled Water Facilities;
WHEREAS, the District is the Lead Agency pursuant to the California Environmental
Quality Act ("CEQA") and has prepared an Initial Study that evaluated the potential
environmental effects associated with the Property acquisition to determine ifthe Property
acquisition could create any significant environmental impacts;
WHEREAS, based on the information contained in the Initial Study and the
comments received from responsible agencies and the public, the District has determined
that no significant impacts will occur because of the Property acquisition and the Distiict
has prepared a Negative Declaration of environmental impacts forthe Property acquisition;
WHEREAS, on October 8, 2001, the Notice of Intent to adopt a Negative
Declaration for the Property was posted at or near the property and, on October 9,2001,
such notice was also provided to and posted by the Alpine County Clerk;
WHEREAS, in response to the Notice of Intent, one comment letter was received
from the Alpine County Child Care Services and one comment letter from a memberofthe

1 WHEREAS, on November 1, 2001, the District considered adoption ofthe Negative
2 Declaration and took additional comments from the public; and
3 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

The Board of Directors of the District has independently reviewed the initial
Study, proposed Negative Declaration and all comments received from
responsible agencies and members ofthe publicforthe Property acquisition.
The Board of Directors of the District has reviewed and considered all written

and oral comments received from responsible agencies, interested parties
and members of the public on the proposed Negative Declaration of
environmental impacts.
The Board of Directors of the District finds that upon review of the Initial
Study, the proposed Negative Declaration and in consideration of all
comments received that there is no substantial evidence that the Property
will have significant impact on the environment.
The documents which comprise the record of the proceeding upon which the

16 decision to adopt the Negative Declaration is based are located at the
17 offices ofthe South Tahoe Public Utility District at 1275 Meadow Crest Drive,
18 South Lake Tahoe, CA 96150 in the custody of the Clerk of the Board.
19 WE, THE UNDERSIGNED, do hereby certify that the above and foregoing
20 Resolution was duly and regularly adopted and passed by the Board of Directors of the
21 South Tahoe Public Utility District at a regular meeting duly held on the 1st day of
22 November 2001, by the following vote:
